LOng <br /> Drvrsian Director <br />RE: Soaring Eagle Gravel Pit, File No. M-99-025, Third Adequacy Review <br />Dear Mr. Settle: <br />The Division has reviewed your responses to the preliminary and secondary adequacy review letters <br />regarding the Soaring Eagle Gravel Pit application. Listed below are the remaining issues that were not <br />adequately addressed. Please respond to these remaining issues as soon as possible. Your responses <br />must be received by the decision due date set for June 3, 1999. Failure to submit your adequate <br />responses, or submit a written request for extension of the decision due date, by June 3, 1999, may <br />result in denial of this application. <br />REMAINING ADEQUACY ISSUES <br />1. The Division has not yet received your response to the CDQW letter dated April 12, 1999. Please <br />indicate how the CDOW concerns will be addressed. The Division is in agreement with the <br />recommendations proposed by CDQW and highly recommend that they be incorporated into the mining <br />and reclamation plan. <br />2. Due to the amount and type of overburden to be used for backfill, prior to topsoil replacement, the <br />Division accepts the commitment to replace a minimum of 6 to 8 inches of topsoil. However, any <br />non-mined areas that require revegetation must be ripped to a two foot depth prior to topsoil <br />replacement and revegetation. <br />3. Due to the high groundwater level and highly permeable gravel deposit at this site, any spill <br />containment structure will be required to be lined with an impermeable material. Also the spill <br />containment structure will need to be sized to contain the contents of the largest container stored <br />within it. Please submit appropriate designs for the proposed spill containment structure, and indicate <br />where it will be located. <br />4. A commitment to conduct weed control is not a weed control plan. Please consult your local weed <br />control agent, and submit an adequate weed control plan, approved by that agent. See the enclosed <br />weed policy adopted by the Mined Land Reclamation Board on July 29, 1998. <br />5. Please include the permanent structures on the reclamation plan map, including the shed and corral <br />and any proposed fencing. <br />6. The Division agrees to accept GJP's commitment that the inlet and outlet structures will be designed, <br />by a certified professional engineer, to safely pass the 100 year flood event. However, as-built <br />designs, verifying the construction of these structures, will be required. <br />
