Perry,Ckrk & Rernrder,Lo~ounty, CO <br />(b) If at any time the Lease expires or terminates in <br />accordance with its terms, or if (subject to <br />subparagraph (a) above) Lessee fails to keep or <br />perform any covenant or condition contained in the <br />Lease, Lessor, at his option, shall have the right <br />to re-enter the Leased Premises without any <br />requirement of prior notice or legal process, and <br />to have and possess the Leased Premises again, and <br />to wholly exclude from the Leased Premises both <br />Lessee and any and all persons claiming by, through <br />or under Lessee, subject to Lessee's right and <br />obligation to remove mining equipment and <br />improvements from the Leased Premises, and Lessees <br />right for a period of one (1) year following such <br />termination to remove from the Leased Premises all <br />sand, gravel and other materials which may have <br />been accumulated thereon (subject to payment <br />therefore, as removed, at the same rate of royalty <br />as set forth in this Lease). <br />(c) In addition to any obligations of Lessee under the <br />Lease, upon termination or expiration of the Lease, <br />for any reason, Lessee covenants and agrees to <br />reclaim any and all portions of the Leased Premises <br />on which it has conducted any operations to the <br />fullest extent feasible. Lessee will exercise its <br />best efforts to replace any removed topsoil and <br />reseed with native grass and take such other <br />measures as may be appropriate to return the <br />reclaimed area to grasslands equal or better in <br />quality than the surrounding grasslands. Without <br />limiting the foregoing, Lessee sriall also comply <br />with any and all reclamation requirements imposed <br />by any federal, state or local governmental agency, <br />including without limitation the Mined Land <br />Reclamation Soard of the State of Colorado, and <br />shall post all bonds required by any such <br />authority. <br />(d) Upon termination or expiration of this Lease in <br />accordance with its terms, Lessee covenants and <br />agrees to execute and deliver to Lessor such <br />written release or other appropriate documentation <br />as may be necessary to evidence such termination or <br />expiration. <br />1z. Notices. Any notice or other communication given by <br />either party to the other relating to this Lease shall be <br />personally delivered or sent by certified mail, return receipt <br />requested, addressed to such other party at the respective <br />addresses set forth below (or at such other address as may be <br />designated from time to time by notice given in the manner provided <br />6 <br />U-~ <br /> <br />
