J <br />AGREEMENT BETWEEN <br />COOLSY GRAVEL COMPANY <br />AND <br />WELL OWNER <br /> <br />WHEREAS Cooley Gravel Company is currently extracting sand and <br />gravel from MLRD Permit #M-89-066, also known as the South Dahlia <br />Pit and, <br />WHEREAS Cooley Gravel Company intends to use a dry mining method of <br />extraction which involves pumping of groundwater from within an <br />impermeable slurry wall barrier and this pumping activity, although <br />being a very remote possibility, can cause a lowering of the <br />groundwater table in the vicinity and, <br />WHEREAS the City of Commerce City has conditionally approved the <br />dry mining amendment to the mining and reclamation plan. <br />Therefore, Cooley Gravel Company agrees to observe the following <br />procedure to protect and mitigate any negative impacts directly <br />attributable to Cooley's dry mining operation to the real owner of <br />the well, <br />This Agreement is based on the following procedures and <br />stipulations: <br />1. All wells that are protected under this agreement are shallow <br />in nature and divert water from the Valley Fill aquifer. All <br />wells recognized in this Agreement have to be permitted or <br />decreed through Colorado law. <br />2. Cooley Gravel Company may choose to mitigate damaged wells <br />using any of several alternatives depending on the situation. <br />The methods are described in (3). <br />3. The methods of replacing water supplies to these wells include <br />1) recharge of the aquifer either through the existing well or <br />through recharge ponds or trenches; 2) trucking in a <br />replacement water supply and providing distribution <br />facilities; 3) supplying bottled water on a temporary basis; <br />4 ) drilling a new domestic exempt well to a non-tributary <br />aquifer; or 5) resetting the pump in the existing well to a <br />lower depth. <br />4. If Cooley Gravel Company chooses to replace a domestic well <br />with anew non-tributary well, it will be drilled to the <br />closest aquifer available. The well will be drilled by a <br />licensed well contractor and all necessary permits will be <br />obtained by Cooley Gravel Company. <br /> <br />
