;~, 1. <br />SAND AND GRAVEL LEASE <br />ry <br />This Lease, in duplicate, is dated this 2 9 day of <br />T4~y 1980, at Gunnison, Gunnison o~, Colorado <br />between: ~ <br />1. OA'NER. The Owner is: <br />JOHN L. ROZMAN JR. and MARILYN K. ROZMAN, hereafter <br />termed "ROZMAN". <br />2. LESSEE. The Lessee is: <br />• NALCO, INC., a Colorado corporation, hereafter termed <br />"NALCO". <br />w <br />3. LEASE OF PREMISES. For and in consideration of the <br />covenants, terms and conditions herein contained, ROZMAN leases <br />and by these presents does grant, demise and lease unto NALCO the <br />real property set forth and described in attached exhibit 'A", <br />_~'together with the existing right of access to and from Colorado <br />State Highway 135. <br />It is understood and agreed that the first portion of <br />the lease premises to be utilized under this Lease shall be the <br />forty acres where the existing sand and gravel operation is <br />located and which is described as the Northwest Quarter Northeast <br />Quarter, Section 13, Township 14 South, Range 86 West, 6th P.M., <br />Gunnison County, Colorado; and that thereafter the sand and gravel <br />operation will continue on the contigious property. <br />4. PURPOSE OF LEASE. NALCO, under the terms and .wn- <br />ditions of this Lease, shall have the exclusive right to explore, <br />develop, mine, treat, store, remove and market from the property <br />all sand and gravel deposits located thereon, together with the <br />right and privilege of using so much of the surface of said <br />property as may be necessary, useful or convenient for the rights <br />herein granted. No buildings or permanent structures shall be <br />constructed or placed upon the leased property without the prior <br />written permission of ROZMAN. <br />5. TERM OF LEASE. The primary term of this Lease <br />shaiY be for five (5) years to commence at 72:00 o'clock noon on <br />the date of execution of this Lease Agreement and to terminate at <br />12:00 o'clock noon five (5) years from the date of execution, <br />under the terms and conditions herein set forth. In addition <br />thereto,, the Lease shall be extended for additional five-year <br />terms so long as the minimum annual lease payments are paid by <br />NALCO to ROZMAN. <br /> <br />
