EXHIBIT D <br />State Pit No. 38 (Mining Plan) <br />Note: This Exhibit D has been mod f ed by clan Eying the term "stabilize" as it applies to <br />overburden stockpiles. <br />The State Pit No. 38 is a proposed sand and gravel mine on the paved Moffat County <br />Highway No. 4 -approximately 5 miles northeast of the Eddinger Bridge crossing the <br />Little Snake River (see Exhibit B-2). The center of the affected area will be located in a <br />portion of State Tract No. 38, which is also described as Lot IS (NWl/4SE1/4) of <br />Section 36, T12N, R95W of the 6a' P.M., Moffat County, Colorado (see Exhibit A-4). <br />The purpose of the mine is to provide road construction materials for the development <br />and maintenance of several county roads in that vicinity. <br />The only man-made improvements that may have a "defined current and recognizable <br />value of an economic nature" on, or within 200 feet of, the affected area are (1) the main <br />access road from County Road No. 4; and (2) a primitive access trail to the BLM land <br />north of the project as shown on Exhibit C-3. There is an abandoned four-acre well- <br />drilling pad on Moffat County's State Lease #GP 3440 that does not have a defined, <br />current and recognizable value of an economic nature. Moffat County will mine and <br />reclaim the abandoned well-pad structures along with the other affected areas of our <br />permit (see Exhibit D-1). <br />The significant disturbances will be limited to the mining, storage and removal of the <br />road construction materials, including sand, clay and gravel products; no off-site facilities <br />will be involved. If it is practical, Moffat County will protect the integrity of the <br />Stormwater drainage basin running north through the center of the affected azea, <br />however, we will mine-out the gravel resources beneath the dry wash if they are <br />substantial -subject to the applicable permit requirement within the jurisdiction of the <br />Army Corps of Engineers. <br />The Stormwater Drainage regulations require an operator to prevent Stormwater from <br />entering the mining area; and to prevent discharging water into the natural drainage <br />without first developing berms, ditches and basins to settle out the suspended solids. If <br />low areas tend to impound significant amounts of water, Moffat County will notify the <br />surface owner of the water status, and will suggest that they file for a water storage right <br />in order to put the water to a beneficial use. <br />The topsoil depth is from 6 to 10 inches throughout the affected area. This dark organic <br />topsoil will be stripped; the stockpiles will be stored in an inactive portion of the affected <br />area, and they will be protected from the drainage channels until needed for reclamation. <br />The topsoil piles will be protected from other stored materials. Seeding them with Moffat <br />County's seed-mix formula will stabilize the topsoil piles -and signs will be placed to <br />identify the topsoil and to caution against removing it. The crushed road-base stockpiles <br />will be identified, protected from erosion, and kept separate from other stockpiled <br />materials. Moffat County will stabilize overburden stockpiles if they are to be stored for <br />State Pit No. 38 -Moffat County Road Deparunent <br />
