<br />Sec, 10. CULTU 2\L ItCSUUI:C ES.
<br />(a) She Authu rized Officer may require a survey of all or par[ of the licensed land
<br />to provide an inventory of an: historical, cu1[u cal and archaco logical [glues.
<br />The survey shall be cund ucted by a qualified processional arc heolog isc, app ruvcd
<br />by the Authorized Officer, and a report of [he survey shall be submic[ed to [he
<br />Authorized OtCicer. The exploration opera[io ns may be conditioned on [he
<br />approval of [he survey report and the approval of measures to protect [he his-
<br />torical, cultural and archeological values. The cast of any survey or measures
<br />[o protect such values discovered as a result of [he survey shall be borne by
<br />Che livens de and items and features of historical, cultural, or arc heological
<br />value shall remain under the jurisd is [ion of the Unlced S[a[es.
<br />(b) If any items or features of his [o rica 1, cultural or arc heeloglcal value are
<br />d lstovered during exploration operations, [he licensee shall iemediately no [ify
<br />the Mining Supervisor and~[he Dis [r ice "tanager (ELM) and shall not dis curb
<br />such items or features until the Mining Supervisor and the District ?tanager
<br />(BLM) issue ins [ructions. IE the licensee is ordered to take measures [o protect
<br />any items or features of historical, cultural or archeological value discovered
<br />during exploration operations, the cost of the censures shall be Lorne by [he
<br />licensor and such items and tea[ures shall regain under [he jurisdiction of the
<br />United Stales. The Gove rnmen[ will evaluate such discoveries and specify appropriate
<br />mitigating measures not later Chan 10 working days after not if lc at SOn.

<br />Sec. 11. USE OF DATA - The licensee shall furnish to the Mining Supervisor copies of all
<br />daze (including but rot limited co, geological, geophysical, and core drilling analyses)
<br />obtained during exploration. the lirensee shall submit such data and, vh.e re appropriate,
<br />the methods by which the data were gathered, a[ such Lice and in such fora as required
<br />by the Mining Supervisor, the Authorized Officer, or surface management agency, or as
<br />specified in [his license, or the plan. She confidentiality of all data so obtained
<br />shall be ma in tam ed until after the areas involved have been leased or until such time
<br />as [he Mining Supervisor determines [hoc making the data available to the puSlic would
<br />not damage the compe[icive positions of [he licensee, whichever comes first. The
<br />applicant may be required to collet[ and repot[ ground water data co the Authorized
<br />Officer.
<br />Sec. 12. UNLAWFUL I\TEPJ:Si - Uo Member of, or Delegate co, Congress, or Resident Com-
<br />missioner, of ter his election or appoin rent, or either before or after he has qualified
<br />and during his ccncinuance in office, gad no officer, agent, or emplo}•ee of the Depart-
<br />ment of [he Interior, except as provided in 43 CFR 7.4(a)(1), shall be admicced co any

<br />provisions of section 3741 of the Revised Scatu cos of [he Uri Led Etaces, as amended

<br />Sec. 13. BOND - The licensee shall file with [he appropriate BL:f office a compliance bond
<br />in the amount of 510.000.00 to ensure cocp liance with the ce rms and conditions of
<br />the license and regulations. 4nere the surface of [he land being explored is in private
<br />ownership, [he authorized officer shall not terminate the period of liability under the
<br />compliance bond until he has received written acknowledgeienc from [he surface owner of
<br />his satisfaction with the reclamation of the surface. In the even[ the Licensee and sur-
<br />face owns rs are unable [o reach agreement on [he adequacy of the reclamation, [he authorized
<br />officer shall make [he final dote ninac in n. He will terminate [he period of liab ili[y under
<br />Che compliance bond after determining that the to rms and conditions and special stipulations
<br />of the license, the approved plan, and the regulations have been met.
<br />Sec. 14. SPEC I.V. STIPULATIONS - (a) the terns "historical, cultural or archeological'; as
<br />used in Section 10 of [his license shall be construed [o indlude, but no[ be limited to,
<br />any and all antiquities, including hiscorlc or prehls Cori[ ruins, fossils or ocher artifacts.
<br />Wherever Section LO (b) of this license requires the licensee to notify [he Dis[ric[ Ptanage r,
<br />such notification shall be made [o the Area 1'nna,ger (such not if ita[ion shall he deemed [o
<br />comply with [he requ icemen[ to notify [he Dis[ric[ `tanager of any discoveries). '
<br />(b) Except as specifically authorized in advance by [he DSs[rlcc .`!anaSer, no exploration
<br />activities will 6e conducted on the lands included in this license between ."arch IS and June
<br />IS of any calendar year. This stlpu la[icn Ss intended to protect sage grouse scrueting areas
<br />e[ mating and nesting time.
