Memo to PCPC <br />Re: SUP No. 671 (Amended) 1-Year Review <br />January 12, 1998 <br />Page 3 <br />6. The applicant will need to maintain valid access easements for this site if the <br />haul route is to cross property not owned by the applicant prior to connecting <br />with the County maintained portion of Baculite Mesa Road. <br />7. Special Use Permit No. 671 shall be approved for a total mining area to include <br />the described 1,970± acres as identified in the mine area plan and the vicinity <br />map, herein attached as Exhibit No. 11. The Special Use Permit Area shall be <br />that area where actual mining takes place and shall coincide with the bonded <br />area as described within the Mined Land Reclamation Board (MLRB) <br />authorization 111 Permit currently numbered M-96-006, and as it may be <br />amended to a 112 Permit (Applicant shall provide an amended MLRB Permit <br />Number to the Department of Planning and Development immediately upon <br />authorizationlissuance of the 112 permit by the MLRB). The mineral extraction <br />and processing activities authorized under Special Use Permit No. 671 <br />(amended) shall only be permitted within the acreage which is described and <br />regulated under the Reclamation Bond as identified by the MLRB Permit No. M- <br />96-006, as amended, and regulated through the State of Colorado, Department <br />of Natural Resources, Mined Land Reclamation Division, except that the <br />combined area of mining, processing, and stockpiling activity and reclamation <br />activity area shall not exceed 100 acres at any given time. Additional mining <br />activities upon lands within the described 1,9701 acres, but not covered by the <br />financial assurance bond associated with MLRB Permit No. M-96-006, as <br />amended, or additional acreage to be placed into mining or reclamation under <br />the approved MLRB Permit No. 96-006, as amended, in excess of the stated <br />maximum limit of one-hundred (100) acres, would require an amendment to this <br />special use permit. <br />8. The applicant shall prepare and submit prior to any mining activity being <br />conducted, a detailed mine-site area plan which identifies the location of all <br />electric utility lines, support structures, and/or gas/oil pipelines traversing the <br />permitted property which will require afifty-foot either side of the centerline <br />safety buffer. Said safety buffers shall be identified on the site plan. <br />9. The applicant shall submit to the Department of Planning and Development a <br />detailed mining operations plan which identifies the sequence and directions <br />which the mining activity will follow. Said plan may be combined with the above <br />referenced detailed site area plan. <br />10.The Baculite Mesa LLC shall develop, operate, and manage the proposed <br />mining-related activity according to the stipulations of the Letter of <br />Understanding executed November 13, 1996, between the Baculite Mesa LLC <br />
