The applicant shall provide notice to the Department of Planning and <br />Development when mining activity requiring in excess of the 20-vehicle trips per <br />day indicated by Exhibit No. 536. herein attached, shall commence. <br />3. The applicant shall repair in c3ood workmanlike manner any damage his hauling <br />operation has caused to Baculite Mesa Road, as determined by the Pueblo <br />County Department of Public Works. Repairs shall restore the road to a <br />condition as good as or better than existed prior to commencement of the <br />applicant's operations under this SUP as determined by Pueblo County <br />Department of Public INorks. <br />A. Prior to commencing a hauling operation in excess of the twenty vehicle trips <br />per day identified in Condition No. 2 above and Exhibit No. 9B, herein <br />attached, the owner shall notify Public Works and a core sample of the road <br />will be taken by an independent soils testing laboratory. During the hauling <br />operation, the ownE;r shall submit copies of their truck load or tonnage tickets <br />to Public Works and upon completion of the hauling another core sample will <br />be taken. The core samples shall be used to help determine the extent of <br />any damage to the road together with a visual inspection of the truck load or <br />tonnage tickets. The owner shall be responsible for the repair of the damage <br />to the road attributable to their operation. Core samples and tests shall be <br />paid for by the owner. <br />B. The owner shall submit a tabulation of their truck load or tonnage tickets on a <br />monthly basis to the Department of Public Works. <br />4. The applicant shall be responsible for all traffic control during roadway repairs <br />required in Condition No. 3. Prior to commencing any roadway repairs, the <br />_ _ _applicant shall submit <a traffic control plan to Public Works which has been <br />pi-epare~Tby a traffic control supervisor certif+ed-by the.Am?rican Traffic Safety _ <br />Services Association, Inc. No roadway repairs will be started prior to approval of <br />the traffic control plan by Public Works. <br />5. Prior to commencing any road work repairs, the applicant shall show evidence of <br />a valid and in-force Bodily Injury and Property Damage Liability Insurance <br />Policy, with minimum limits of six hundred thousand dollars ($600,000.00) per <br />occurrence and 1.2 milYion dollars ($1,200,000.00) general aggregate. Such <br />policy shall be for the protection of the County from all suits, actions., or claims of <br />any type for injuries or damages allegedly sustained by any person or property <br />on the premises or as ai result of the operations of the work. Such policy shall <br />specifically cover the acts and operations of any subcontractors or independent <br />contractors of the applicant in addition to the applicant's employees or agents. <br />
