As <br />mining continues, the total surface area disturbed at any one time <br />will not be increased because Energy Fuels is not expanding exist- <br />ing levels of production. Furthermore, the area which will be <br />disturbed will be reclaimed to beneficial uses similar to adjacent <br />areas. <br />(k) Protection of endangered and threatened species anc their critical <br />habitats as determined by the Endangered Species Act of 1973 (16 USC <br />1531, et seq.). <br />Energy Fuels regards the protection of endangered and threatened <br />species and their critical habitats as determined by the Endangered <br />Species Act of 1973 (16 USC 1531, et seq.) with the highest concern. <br />• However, there are no such species within the mine plan or adjacent <br />areas.
