If the Operator submits <br />a new runoff model based on the existing culverts (see no. 2 above), the Operator will <br />need to sulmit for Division approval a re-evaluation of the minimum spillway profile <br />including any re-sizing which may be necessary. Since the due date for this corrective <br />action was April 15, 1997, spillways need to be reconstructed to meet the revised minimum <br />spillway profile as approved by the Division as soon as possible. See Possible Violation <br />PV-1 on page 4 of this report. <br />Entrance Gate Diversion A required component of the sediment control plan is a <br />structure near the entrance gate to divert runoff on the paved access road into the <br />entrance gate sediment pond. As of the date of this inspection, there is no diversion <br />structure in place. The Division will require that a diversion structure acceptable to <br />the Division be installed as soon as possible. See Possible Violation PV-1 on page 4 <br />of this report. <br />Since there are two different diversion structures under consideration, the Division <br />wants to clarify the requirements for this corrective action. The Operator initially <br />proposed to use an asphalt `swale' or diversion dike in their revision to the sediment <br />control plan dated March 27, 1997. As stated in an April 1, 1997 memo, the Division <br />believes that a Swale or dike would detract from the utility of the road. However, the <br />Division will approve installation of an asphalt diversion dike if the Operator submits <br />written verification from the landowners or their representative stating their acceptance <br />of the structure. <br />In the absence of such an agreement, the Division will require installation of an <br />alternate diversion structure. On April 18, 1997, the Operator submitted a schematic <br />for a grated transverse ditch and cattle guard with an inferred depth of 18" to 3' from <br />west to east. The schematic did not specify the width of the ditch. To complete our <br />evaluation of this structure, the width and depth needs to be specified. When this is <br />received by the Division and approved, this structure can be installed. it should be <br />noted that the landowners have expressed their willingness to assist with the <br />installation of this structure. The Division's authority is only with the Operator in <br />regards to this permit, therefore, we will not participate in any negotiations between <br />the Operator and the landowner involving its completion.
