If the Operator submits a new runoff model based on the existing culverts (see no. 2 above), the Operator will need to sulmit for Division approval a re-evaluation of the minimum spillway profile including any re-sizing which may be necessary. Since the due date for this corrective action was April 15, 1997, spillways need to be reconstructed to meet the revised minimum spillway profile as approved by the Division as soon as possible. See Possible Violation PV-1 on page 4 of this report. Entrance Gate Diversion A required component of the sediment control plan is a structure near the entrance gate to divert runoff on the paved access road into the entrance gate sediment pond. As of the date of this inspection, there is no diversion structure in place. The Division will require that a diversion structure acceptable to the Division be installed as soon as possible. See Possible Violation PV-1 on page 4 of this report. Since there are two different diversion structures under consideration, the Division wants to clarify the requirements for this corrective action. The Operator initially proposed to use an asphalt `swale' or diversion dike in their revision to the sediment control plan dated March 27, 1997. As stated in an April 1, 1997 memo, the Division believes that a Swale or dike would detract from the utility of the road. However, the Division will approve installation of an asphalt diversion dike if the Operator submits written verification from the landowners or their representative stating their acceptance of the structure. In the absence of such an agreement, the Division will require installation of an alternate diversion structure. On April 18, 1997, the Operator submitted a schematic for a grated transverse ditch and cattle guard with an inferred depth of 18" to 3' from west to east. The schematic did not specify the width of the ditch. To complete our evaluation of this structure, the width and depth needs to be specified. When this is received by the Division and approved, this structure can be installed. it should be noted that the landowners have expressed their willingness to assist with the installation of this structure. The Division's authority is only with the Operator in regards to this permit, therefore, we will not participate in any negotiations between the Operator and the landowner involving its completion. The Operator is ultimately responsible for ensuring that the ditch is installed without restricting access.
