i Both State and Federal records were examined, and nothing within the proposed permit area is capable <br />of being classified as an azea designated unsuitable for mining. The investigation included review of the <br />following items: <br />1. State and local land use plans <br />2. Fragile and historic lands <br />3. Potential for loss or reduction of long range productivity of water supply and food of <br />fiber products <br />4. Natural hazazd lands in relation to endangering life and property. <br />5. Areas of unstable geology and frequent Gooding <br />6. Public health and safety <br />7. Lands subject to prohibitions or limitations <br />Previous findings by the DMG in conjunction with previous permit renewals have confirmed that. <br />1. The permit area is not within an azea designated, or under study for designation, as <br />unsuitable for surface coal mining operations. <br />2. There are no occupied dwellings within 300 feet of the mine permit boundary or land <br />subject to prohibitions or limitations. <br />2.03.8 PERMIT TERM INFORMATION <br />The original Permit to Conduct Coal Mining in Colorado was approved for the Hayden Gulch Mine on <br />January 4, 2981. The most recent renewal of Permit No. C-80-003 was approved February 11, 1997 and <br />• expires January 4, 2002. A permit renewal application was filed with CDMG on July 11, 2001, <br />In response to the 1984 mid-term permit review by the MLRD, HGCC revised its pemut to reflect a <br />substantially shorter Gfe-of--mine and smaller mine operation than originally planned. In November 1987, <br />HGCC submitted a Notice of Intention for Temporary Cessation to the MLRD which was followed by <br />several Technical Revisions (I'Rs) to the permit pertaining to final reclamation and mine closure plans. <br />In September 1987, HGCC submitted a Phase I bond release request for the estimated 318 mine aces that <br />had been reclaimed from 1978 through 1986. That request was approved by the MLRD in March 1988. <br />The 30 acre mine facility area, which was reclaimed in 1987, included the shop, warehouse, offices and <br />powder magazine facilities. Since 1987, activities at the mine and under this permit have consisted of <br />routine environmental monitoring, minor reclamation maintenance work, and periodic evaluation of <br />reclamation success. A Phase I bond release request for the 30 aae mine facility azea was submitted in <br />July 1996. That request was approved by DMG in )tine 1997. <br />The Mining and Reclamation Permit was renewed again in January 1992 and the Division initiated a mid- <br />term review in August 1994. This Technical Revision permit request was prepared partially in response <br />to that mid-term permit review. <br />In February 1998, HGCC submitted a Phase II/Phase III bond release request for an estimated 357 aces <br />that had been reclaimed between 1978 and ] 987. The DMG approved the request in June ] 999. The <br />bond release request covered both mine-pit and facility areas. Excluded were three shmb enclosure areas <br />(Pond 003, Pond HG-8 and Parcel E) and the slump area at the former highwall. Technical Revision 68 <br />(I'R-68), which is located at the front of this pemut volume, presents changes that occurred to the permit <br />as a result of the partial Phase II/Phase III bond release. <br />For reference purposes, Table 2.08-1 in Section 2.08 summarizes all permit stipulations and revisions <br />proposed or approved since the January 1987 renewal. 1987 was chosen as the "base year" for this TR <br />document since it represents the termination of mine and reclamation operations at the mine and <br />beginning of the post reclamation monitoring period.
