Cottony <br />Division Director <br />Natural Resource Trustee <br />RE: Gravel, LLC, File No. M-2005-045 <br />Rock Dog #I 112(c) Permit Application- Adequacy Review <br />Dear Mr. Carnahan, <br />Listed below are adequacy review comments for the Rock Dog #1 112 (c) Permit Application, File No. M-2005- <br />045. The Division of Minerals and Geology ("Division") is required to make a recommendation decision no later <br />than November 1, 2005, therefore, your response to the following adequacy review concerns should be submitted <br />to the Division as soon as possible. <br />As required by Rule 1.6.5 (2), please submit the proof of publication of the public notice circulated in the <br />local newspaper and all owners of record of surface lands, and easement holders that are on the affected land <br />and within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified <br />Mailing or by proof of personal service. Additionally, note the enclosed objection letter, which indicates that <br />one of the adjacent landowners may not have been notified. Please identify whether this landowner is, in fact, <br />adjacent. If so, notification will need to be made to this landowner and the comment period will be reopened <br />to allow for additional comment from this and other parties. <br />Rule 6.4.3 Exhibit C- Pre Minine and Mine Plan Map(s) of Affected Land <br />2. Rule 6.4.3 (b) states that the map(s) must pornay the name and location of all creeks, roads, buildings, oil and <br />gas wells and lines, and power and communication lines on the area of affected land and within two hundred <br />(200) feet of all boundaries of such area. Although some of these features appear on the Pre-Mining and <br />Mine Plan Map, it appears that some have been omitted, i.e. the presence of the BP well site absent of any <br />pipelines. Please include all of the applicable structures identified in this rule. <br />Rule 6.4.3 (d) states that the Pre-Mining and Mine Plan map should reflect the total area to be involved in the <br />operation, including the area to be mined and the area of affected lands. Rule 1.1(3) defines affected lands as <br />including roads. The proposed access road to the site is located partially outside of the permit boundary. The <br />installation of this roadway is construed as affected land and must be contained within the permit area. Please <br />modify the map, and acreage, if applicable, to include the entire access road in the permit boundary. <br />Additionally the current Pre-Mining and Mine Plan Map identifies a portion of the permit area as "Possible <br />Affected Area" Please be aware that if this area is, in fact, affected during the life of the permit, a revision to <br />the permit, in the form of a technical revision or an amendment, will be necessary, which describes the nature <br />of the activity in this area, prior to commencement of that activity. <br />Office of Office of Colorado <br />Mined Land Reclamation Active and Inactive Mines Geoloeical Survev <br />
