Long <br />Division Director <br />The Division received your letter of March 28, 1995 requesting an <br />extension to the decision due date for the Chapparral Pit application. <br />This extension is accepted by the Division and the new decision date is <br />April 28, 1995. <br />Listed below are adequacy review comments on the permit application. <br />The Division is required to make an approval or denial decision no <br />later than April 28, 1995 therefore, your response should be submitted <br />to the Division as soon as possible. If you feel more time is needed to <br />complete your reply, an extension to the decision date can be granted <br />by the Division upon receipt of a written waiver of your right to a <br />decision by April 28, 1995 and request for additional time. <br />1. The application states that the barbed wire fence in the <br />southwestern portion of the permit area is the only permanent man- <br />made structure located on the premises. Please clarify if this or <br />any other such structures are located within 200 feet of the area <br />to be mined. Are there structures outside the permit area but <br />still within 200' of the pit such as power lines, public roads or <br />irrigation ditches. <br />For any of the structures listed above, you need to submit a <br />waiver from the owner which allows you to mine within 200 feet of <br />that structure. Alternatively, you can submit verification of an <br />agreement with the owner that any damage caused by the operation <br />will be compensated for by the operator.
