M-97-084/2nd Adequacy Response <br />11/7/97 Page 2 <br />The south edge of the permit area abuts a level pasture. It is <br />proposed to place a temporary 4' chainlink fence approximately 10' <br />inside the south permit boundary from the cliff face to the end of <br />the material to be mined so that if material rolls down the mining <br />area, it will be stopped from rolling into the adjacent pasture. <br />EXHIBIT D - Reclamation Plan: You concur that the remaining <br />undisturbed slopes on the alluvium may be left at their undisturbed <br />gradient with the gradient in the chute of 3:1. Be aware that a 3:1 <br />slope within the chute physically cannot be done unless Scenario #3 <br />of the Longitudinal Sections is the true configuration of the <br />bedrock. Thus to state that all disturbed areas should be reclaimed <br />to 3:1 may be impossible. <br />As mentioned in Exhibit B, the channeling and control of the water <br />and debris from the post-mining channel will be addressed by the City <br />permitting process. <br />A geologic hazard investigation may be required when a building <br />permit is requested. If the City of Ouray determines one is <br />necessary while the MLRB permit is active, a copy will be forwarded <br />to you. <br />EXHIBIT L - Structures: An agreement between the City and permittee <br />will be sent as soon as it is developed. <br />Again the Highway has not been flooded with water or debris from this <br />fault channel. Therefore, it is again proposed to allow the City <br />permitting processes to address this point. <br />NOTIFICATION: Enclosed is the affidavit from the publisher. <br />The certification that the responses to Adequacy Review Letter Dated <br />10/30/97 has been added to the MLRB Application for public review <br />with the Ouray County Clerk will be sent to you. <br />RECLAMATION COST ESTIMATED: <br />For Partial Mining of 1.0 Acre: <br />Task 1 - Rough Grading of affected area: <br />Cost for task: 4 hrs Q$65/hr = $260 <br />Task 2 - Ripping compaction (road, process/stockpile area) <br />Cost for task: 1 hr Q$65/hr = $65 <br />Task 3 - Topsoil replacement on affected area. <br />Cost for task: _ $0 No topsoil is available. It is proposed to <br />broadcast seed into the sand/gravel that covers the area. Two <br />examples of this type of revegetation in the immediate area are the <br />North Ouray Corridor project and the Ouray Vista Subdivision near <br />Skyrocket Creek. <br />Task 4 - Revegetation of affected area <br />Cost for task: Agree to $100 <br />Task 5 - Mobilization/demobilization of equipment <br />Cost for task: 1 1/2 hrs @$65/hr = $98. Three separate <br />contractors are within 3 miles of the project. D4-D6 Cat is more <br />than adequate. <br />
