It will consist of the grasses <br />listed 'in Exhibit E on page 10. The final mix application rates-and species will be provided to <br />the Division following approval of the 404 permit and prior to the relocation of the Suttle Ditch. <br />,Flows from the Swale area draining from south to north through the proposed project site will be <br />diverted around the mining operation (please see response to Comment 17). The diversion will <br />begin where the Swale currenfly crosses the southern project boundary and will. end where the <br />drainage now crosses the northern project boundary. The diversion ditch will be sized and <br />constructed to safely convey existing flows and potential dewatering flows around. the project <br />site while minimizing excessive erosion. -Once directed back into the drainage area north of the <br />proposed site, the estimated mine dewatering flows (0.3 to 0.7 cfs) would not be expected to <br />adversely affect drainage within the Swale area. <br />6.4.7 EXHIBIT G -Water Information <br />19. <br />Previously submitted Exhibit C-1, C-2 and Exhibit F show a potential new location for both the <br />Suttle Ditch and the Little River. As discussed previously, the operator commits to relocating ~ ~4. <br />the ditches in the same configuration and flow capacity as currently exists. y~.~irr,+r"` <br />6.4.12 EXHIBIT L -Reclamation Costs <br />20. <br />The Swale area/Little River will need to be relocated during the early course of the mining. As <br />the relocation will take place early, the total amount of disturbance to the site will be less than <br />the maximum shown in .Exhibit L. There will be sufficient bond in the early phases of the <br />mining to relocate and revegetate the Swale area/Little River. There will be approximately 2000 <br />linear feet bf relocated Swale area. As some of the relocated Swale is part of the 404 permit <br />application, the operator will provide the Division with the design and projected construction <br />costs after the 404 permit is approved. <br />.6.4.14 EXHIBIT N -Source of Leal RiEht to Enter n~~~Ul ~,p~} <br />21 <br />On March 11, 2001, More Family Ranches, LLC and Western Mobile Northern, Inc. (Lafarge <br />Corporation) entered into a lease to allow Lafarge Corporation to mine the property and More to <br />receive royalties. Paragraph 1 of the Memorandum of Sand and Gravel Miriing Lease (Exhibit, <br />N) plainly states that Lafarge Corporation may occupy the property and perform all the necessary <br />activities to produce sand and gravel products. Both parties correctly executed the Lease and <br />Memo of Lease. <br />
