A PTl consists of a brief <br />starch for possible sources of WET, which might reveal causes of such tonicity and appropriate corrective actions more <br />simply and cost effectively than a formal TIE. if the PTI allows resolution of tine WET incidem, the TIE need not <br />necessarily bt conducted. This investigation is optional. <br />Within 90 days of she determination of the toxicant or no later than 210 days after demonstration of toxicity, whichever is <br />sooner, a control program is to lx developed and received by the Divisio¢. The program shall set down a method and <br />procedure for elimination of dte toxicity to acceptable levels. <br />e. R~p,ect Fnr Rrlirf <br />The permittee tray request relief from further investigation and testing where the toxicant has not been determined and <br />Division haz determined suitable treatment does no[ appear possible. In requesting such refief, the pertttittee shall subtt~ <br />material sufficient to establish the following: <br />i. It has complied with terms and conditions of the permit cotapliattce schedule for the PTUTfE invesdgatio¢ and other <br />appropriate conditions az may have been required by the Division; <br />ii. During the period of the toxicity incide¢[ it has bee¢ in compliance with all other permit conditions, including, m the <br />case of a POT'W, pretreatment requvcmcnts; <br />iii. During the period of the toxicity incident i[ haz properly maintained and operated all facilities and systems of <br />..treatment and control; and <br />iv. Despite the circumstances described in paragraphs (i) and (iii) above, the source and/or cause of toxicity <br />could not be located or resolved. <br />If deemed appropriate by the Division, the permit or the compliance schedule roes}• be modified to revise the ongoing <br />monitoring and toxicity investigation requirements to avoid an unproductive ezpendimre of the permittee's resotuces, <br />provided that the underlying obligation to eliminate any continuing ezcecdance of the tonicity limit shall remain. <br />f. S(ttlntanrntic n,cgpprarancr. <br />If toxicity spontaneously disappears a[ any time after a rest failure, dtc permittee shall notify the Division in writing within <br />l4 days of a demonstration of disappearance o(dte tonicity. The Division tray requee the permittee to develop and <br />submit additional information which may include, but is no[ limited to, the results of additional testing. If no pattern of <br />toxicity is identified or recurring toxicity is not identified, the tonicity incident response is coasidered closed and normal <br />WET testing shall resume. • <br />Cortected <br />
