Copies of these reports aze [o be
submitted to both the Division and EPA along with the DMR.
The pettninee shall conduc[ as acute 48-hour WET test usirtg f rr~ 'nd~anrnia Dubia. Acute tests will be replacemem static
tests of a single effluent grab sample. The permittee shall conduct each acute WET test in general accordance with
IDethods described in Mrthndc for Meacnring, the Anrtr Toxicity of Fffluentc and Rrr_eiving Waters to Frcahwatrr and
Marine ()rg rtes isms, EPA/600/490/027 or the most currem edition, except as modified by the most cttrrem Division
guidan[z document entitled (;nidelinec for f'nndncring Whnln Ffflnrnt Tnririty Testc.
b. Faih~re of Tnct and Divicinn Nnfificarinn
An acute WET tes[ is failed whenever the LCD, which represents an estimate of the effluent concentration which is lethal
to 50% of the tes[ organisms in the time period prescribed by the tut, is found m be less than or equal to 100 % effluent.
The pertnittee must provide written notification of the failure of a WET test to the Division, along with a statement as to
whether the Preliminary Toxicity Incident ("PTI")/toxicity Identification Evaluation ("TIE") investigation or accelerated
[esting is being performed (see next section). Notification must be received by the Division within 14 calendar days of
the demonstration of acute WET fn the routine requu•ed test. "Demotutration" for the purposes of Parts I.A.4.b., c.,
• d. and f. means no la[er than the less[ day of the laboratory test.
C. Amnmatir Cnm~nliance Srhednlr i Inman Faih~re of Test
If a routine acute WET tes[ is failed, the following automatic compliance schedule shall apply. As pan of this the
permittee shall either:
i. proceed [o conduc[ the PTI(ttE investigation as described in Pan I.A.4.d., or
ii. conduct accelerated testing using the single species found to be more sensitive.
IC accelerated testing is being performed, the permittee shall provide lvritten notification of the results within 14
calendar days of completion of the "Pattern of Toxicity"/"No Totdcfty" demonstration. Testing will be at least once
every two weeks for up to five tests until 1) two consecutive tests fail or three of five tests fail, in which case a panem of
[oziciry has been demontrated or, 2) two consecutive tests pass or three of five tests pass, in which case no panem of
toxicity has been found. If no pattero of toxicity is found the toxicity episode is considered to be ended and routine testing
is to resume. If a panem of toxicity is found, a PTIfI'IE. investigation is to be performed. If a paaero of toxicity is not
demonstrated but a significant ]eve] of erratic toxicity is found, the Division may require an increased frequency of routine
monitoring or some other modified approach.
d.
