COLORADO DEPARTMENT' OF PUBLIC HEALTH AND ENVIRONMENT', Water Quality Comrol Division <br />Rationale -Page 13, Permit No. CO-0000221 <br /> <br />S) General Information: The permittee should read the WE7'resting secrions under Pans /.A.4. and I.A.S. of <br />the permit carefully. The permit outlines the test requirements and the required follow-up actions the <br />perminee must take to resolve a toxicity incident. The permitter should read, along with the documems <br />listed in Parts I.A.4.a, and I.A.S.a. ojthe permit, the Colorado Water Oualirv Comrol Division <br />Biomanitorine Guidance Documem. dated July 1, 1993. This documem outlines the criteria used by the <br />Division in such areas as granting relief from WET testing, modifying test methods and changing test <br />species. The perrnittee should be aware that some of the conditions outlined above may be subject to <br />cJtange if the farility experiences a change in discharge, as outlined in Part II.A.2. of the permit. Such <br />changes shall 6e reported to the Division immediately. <br />6) Eremprion for Surface Runoff Only - Outfal1009.• The discharges from outfall 009 contain surface runoff <br />solely and do not comain toxic pollutams in toxic amoums. On this basis, WET testing is not a requirement <br />for this outfall. However, the Division reserves the right to reopen the permit to include WET testing, <br />should jaciliry conditions change or ij new information becomes available. <br />r1 <br />L J <br />4. Srormwarer Evaluation: Stormwater from active or inactive coo! mining operations that has beers conramirtared by <br />contact with any overburden, raw material, imermediate products, finished produces, byproducts or waste products <br />located on the sire of such operations is required to be covered by a Colorado Discharge Permit System (CDPS) <br />permit in order to be discharged to Waxers aj the Stare. This coverage may be obtained under either a CDPS <br />Industrial Wastewater Discharge Permit or a CDPS Srormwater Discharge Permit. Seneca Coal Company submitted <br />an application for a general permit jot Metal Mining for the Seneca Mine Complex on February 23, 1996. This <br />facility's certification under the general permit became effective on March 22, 1996. The Seneca Mine Complex <br />certification number is COR-040169. <br />Since the requirements for stormwattr permits have just recently become effective, the Division's policy is to cover <br />as many facilities as possible chat are included in the regulations, with general permits. For facilities that also have <br />individual CDPS permits for discharge of process water, airy applicable srormwaler provisions would then be <br />included in individual CDPS permits at the time of individual permit renewal or application. The individual permit <br />for discharge of process water for the Seneca Mine Complex, CDPS permit (No. CO-0000221), will contain <br />s[ormwater provisions. When this permit becomes effettive, certification COR-040169 will be inactivated. Under <br />the terms of the combined individual permit (CO-0000221), Seneca Coal Company will be authorized to discharge <br />stormwater associated with industrial activity imo waters of the State of Colorado. <br />The rernu and conditions of this permit, as related to stormwater discharges, include.• <br />a. Seerexation of Srormwater Discharges: Al! discharges covered by the stormwater portion of this permit shall be <br />composed emirely of stormwater (except as discussed at Part I.D.2.6.9 of the permit). Stormwater which mites <br />x~ith process water is subject to process water comrols. Discharges Jrom sources other than stosmwater must be <br />addressed by the process water controls in this CDPS permit, <br />b. Stormwater Manaeemenr Plans (SWMPs1: The purpose oja SWMP is to identify possible pollutant sources r.har <br />may contaminate stormx~aler and to set out best management practices that, when implemented, will reduce or <br />eliminate arsy possible water quality impacts. <br />A SWMP must be maintained for the Seneca Mine Complex in accordance with good engineering practices. The <br />plan idemifres potential sources of pollution which may reasonably be expected to affect the quality of <br />srormwater discharges associated with industrial activity. In addition, the plan describes and ensures the <br />imp[ememation of practices which are to be used to reduce the pollutants in storrnwater discharges associated <br />x~ith industrial activity at the jaciliry, and assures compliance with the terms and conditions of this permit. <br />Seneca Coa! Company must implemem the provisions of the SWMP as a condition of this permit. Convents and <br />requirements of the SWMP are discussed in the permit ar Part I.D.2.b <br /> <br />c. Compliance Dates: Seneca Coal Company was to have prepared the Seneca Mine Complex SWMP at the time of <br />application . The plan was to have been implemened by upon issuance of the certification. The SWMP shall be <br />updated as appropriate. <br />Certifrcatiort that a ~SWMP was prepared for the Seneca Mine Complex was received by the Division on February <br />23, 1996. <br />
