Section 744.13 (b) Continued. <br />• manner discussed in Section 816.13, Section 816.14, and Section <br />816.15. Energy Fuels will not use trenches and other excavations <br />for coal exploration. All abandonment of exploration drill holes <br />will be in a manner that protects the surface and does not endanger <br />any present or future underground mining activities, other mineral <br />resources, or ground water. No deposit of oil or gas is known or <br />anticipated in the Energy Fuels mine plan area, especially at the <br />shallow depths of exploration drilling. However, if coal explora- <br />tion drilling encounters any oil or gas, special care will be <br />undertaken not to endanger the deposit. <br />Methods of permanent abandonment to be used by Energy Fuels are <br />included in Section 816.132. <br />(c) Notice of abandonment. <br />• (1) Not less than 30 days prior to permanent cessation or abandonment <br />of surface coal mining and reclamation operations, the person conducting <br />those operations shall submit to the Pegional Director, in duplicate, a <br />notice of intention to cease or abandon those operations, with a state- <br />ment of the exact number of acres affected by the operations, the extent <br />and kind of reclamation accomplished, and a statement as to the structures <br />and other facilities that are to be removed from or remain on the permit <br />area. <br />(2) Upon receipt of this notice, the Regional Director, the Mining <br />Supervisor, and the appropriate authorized officer shall promptly make <br />joint inspections, to determine whether all operations have been com- <br />pleted, in accordance with the requirements of the Act; this Chapter; <br />the surface coal mining and reclamation operations permit, lease, or <br />licenses, and the requirements of the approved mining plan. Where all <br />of these requirements have been complied with, the Regional Director <br />shall recommend to the appropriate authorized officer, termination of <br />. the liability under the lease bond of the person conducting surface coal <br />mining and reclamation operations. <br />744-5 <br />
