Colorado ~[ined Land Reclamation Soard Hearing Process:
Typically, any applicaion far a 112 Regular Operarion permit or an amendment to a 113 Re_ular Ooention pz.:~nit
requires a hearing before the Mined Land Reclamation Board when these is a wriren objection. However, prior to the
Formal Boazd Heazing, several other hearings must occur prior to the Forma! Board Hearing.
The Informal Conference:
The first of the three hearings in the process is the Informal Conference. If there are objections-or at the reques-, of the
applicant or local board of county commissioners -the Division will schedule an infomal conference among the
parties. The Informal Conference is held afrer the close of the requred comment period, which is about 50 to 60 days
from the date an application is considered filed with the Division.
The purposes of the informal conference are to:
• Explain the three hearing process to the ponies
• Identify the issues
• Identify the parties
• Determine what issues have been resolved
• Determine if any parties want to withdraw
The Pre-hearing Conference:
The second hearing is the Pre-hearing Conference. It can occur no sooner than te7rc days afrer the Division has made iu
recommendation to approve or deny the applica¢oa for apermit or amendment. However, it must also occur at least
five (5) days prior to the Formal Board Hearing.. The Pre-heating Conference is tuually.conducted by amember ofthe
Mined Land Reclamation Boazd. The Division is required to mail iu recotttmendation to all parries prior to the Pre-
hearino Conference.
The purposes of the Pre-hearing Conference aze to:
• Recommrnd the issues the full Boazd should consider '
• Determine the lists of witnesses and exhtbiu to be presented by the parties at the Formal Public Hearin,
• Determine the amount of time each parry will have to make their presentations at the Formal Public'
Hearing
• " Prepaze a Dcafr Board Order that will be rued to conduct the Formal Board Hearing
The Formal Board Bearing:
The Formal Board Hearing mtut be held prior to the automatic approval date for the permit application or the
amendment At the Formal Board Hearing, the first order of business is for the Board to adopt the Draft Board Order.
Parties may object to the Draft Board Order and seek revisions. Once the Draft Board Order is adopted, the Formal
Board Hearing begins. .
On occazion, an operator may have a consultant represent the operator or company. In order to represent the applicant
or operator, the Boazd and the Attorney General's Office have requested that coasulranu complete a notarized form of
