There <br />have been problems in the past further up river to the west where events similar <br />to the one I just described have occurred. <br />EXHIBIT O (OWNERS OF RECORD) <br />OBJECTION: The 200 foot right of way the applicant is referring to is actually a <br />railroad easement that is measured from the center of the tracks 100 feet to each <br />side of the tracks. My husband's fence is a ground surveyed fence line that is <br />100 feet from the railroad track center line. The applicant's fence line lies 50 feet <br />into the railroad easement. <br />3.0 PLANT AND STOCKPILE AREAS <br />STATEMENT: 'The maintenance facility will be used for project and railroad <br />related maintenance and repair involving the short line freight and tourist <br />operations.' <br />OBJECTION: No proof of compliance with zoning for a tourist "commercial <br />operation" or railroad car repair'industrialznne' has been demonstrated by the <br />applicant. <br />In summary, there are many contradictions, errors, and misinformation contained <br />in the current application. I have only briefly touched on a few that stand out. I am <br />still concerned that Agile submitted to testing schedule or specific pollution <br />criteria for their well monitoring. I am also worried about possible ground <br />contamination from the refueling and possible over filling of the gas tanks on their <br />mobile equipment. <br />I implore you to take another closer look at the new application, There are too <br />many loopholes that can have devastating effects on the neighboring owners, the <br />environment, and the wetlands.
