Permit #M-97-054, The Parkdale Project Dear Larry: I would like to take this time to request that Agile Stone's permit be considered as anew permit application. Due to the changes that have been made to the permit, it is fundamentally and substantially different from the original submission, and contains a comedy of contradictions. I will also take this opportunity to voice my objections to statements made by Agile Stone Systems, Inc. and/or their representatives. Many of their statements which they display as being based of "fact" are grievously erred, and indeed have no basis. SECTION CABLED CONTRIBUTORS: STATEMENT: 'Conducted well capacity tests' OBJECTION: The tests that were performed were actually well-pump output tests. DEFICIENCY NOTICE EXHIBIT D (MINING PLAN) #8 No current dimensions of the sandstone quarry were given in the re-submitted application. DEFICIENCY NOTICE EXHIBIT E (MINING PLAN) #9 OBJECTION: Quantity of top soil has been systematically side-stepped by applicant. #14 STATEMENT: 'Building which will remain after mining for use by the railroads and the rancher. OBJECTION: I do not believe that a commercial building can remain on the property since it is not zoned commercial by Fremont County. #15 OBJECTION: County Road 157 only has a 50 foot combined right of way through Mark Brown's property on the east and west sloes of the rose. This extends northerly to the 200 foot easement boundary of the railroad. Since Mark Brown has not granted an easement to Agile, this road will not be wide enough fortwo-way traffic, especially semi-trucks. #20 OBJECTION: Proof of adequate water is only shown for the first 4 years-not the life of the mine which is rated at 50 years.
