The Discharge Monitoring Report forms shall be tilled out <br />accurately and completely in accordance with requirements of this permit and the instructions on the forms. They shall <br />be signed by an au[horirrd person as identified in Part I.D. <br />3. Acute WET TestinE-Oulfalls 004. 023. 024. 026 and 029 <br />(a) Tesline and Reoortine Requirements <br />Tests shall be done at the frequency listed in Pan LB.1. Test results shall be reported along with the Discharge <br />Monitoring Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., WET testin_ <br />results for [he first calendar quarter ending March 31 shall be reported with the DMR due April 28.) The rc;ult> <br />shall be submitted oo [he Acute Toxicity Test report form, available from the Divuton. Cuptcs uF these reports arc <br />to be submitted to both the Division and EPA along with [he DMR. <br />The permit[ee shall conduct each acute WET test in general accordance with methods described in Methods for <br />Measurine the Acute Toxicity of Effluents and Receivine Waters to Freshwater and Manna Oreanisms, EPA/600/4- <br />90/027 or [he most current edition, except as modified by the most current Division guidance document entitled <br />Guidelines for Conductive Whole Effluent Toxicity Tests. The permittee shall conduct an acute 48-hour WET test <br />using D~a hnia Maena sp., and an acute 96-hour WET test using fathead minnows. Acute tests will he replacement <br />static tests of a single effluent grab sample. <br />(b) Failure of Test and Division Notification <br />An acute WET lest is failed whenever the LCso, which represents an estimate of the effuem concentration which is <br />lethal to 50`70 of the test organisms in the time period prescribed by the test, is found to be less than or eyual to <br />100% effluent. The permit[ee must provide written notification of the failure of a WET test to [he Division, along <br />with a statement as to wheWer the Preliminary Toxicity Incident ('PTT")/Toxicity Identitication Evaluation ("TIE") <br />investigation or accelerated testing is being performed (see next section). Notification must be received by [he <br />Division within 14 calendar days of the demonstration of acute WET in the routine required test. <br />"Demonstration" for the purposes of Parts i.B.4(b),(c),(d) and (f) means no later than the I~t day of the laboratun~ <br />test. <br />(c) Automatic Compliance Schedule Uoon Failure of Test <br />If a routine acute WET test is failed, the following automatic compliance schedule shall apply. As part uF this the <br />pertnittee shall either: <br />(i) proceed to conduct the PTI/TIE investigation as described in Part 1.B.4.(d), or <br />(ii) conduct accelerated testing using the single species found to be more sensitive. <br />If accelerated testittg is being performed, the permittee shall provide written notifwtion ul' the resulU within <br />14 calendar days of completion of the "Pattern of Toxicity"/"No Toxicity" demonstration. Testin_~ .vill he at <br />least once every two weeks for up to five tests until 1) two consecutive tests fail or three of five tests fail, m which <br />case a pattern of toxicity has been demonstrated or, 2) two consecutive tests pass ur three u( five testy pass. m <br />which case oo pattern of toxicity has beep found. <br />Amendment No. 1 Issued Effective <br />
