Stipulation No. 3: The operator wi// commit to a maximum mining depth of 20 feet be%w <br />the current surface /eve/ until he submits the required one (11 year data for groundwater <br />depth and receives written approval from the Division to proceed. At no time shall the <br />operator be a/lowed to mine any closer than two (21 feet above of the established highest <br />groundwater /eve% regardless of its height, without obtaining the app/icab/e permits from <br />a///oca/, state and federa/jurisdictions first. <br />Stipulation No. 4: The operator sha// notify the Division sixty (601 days prior to any <br />disturbance in Phase 3 or mining to a depth over twenty /201 feet so a Financial Warranty <br />Review can be undertaken to ensure adequate bonding is in place. <br />Please note that, at the hearing, the Board has the ability to add, delete, or modify any and <br />all stipulations. <br />The Division has calculated the Financial Warranty amount to be 5132,000.00. The amount <br />is set based on parameters outlined in correspondence from this office on October 1 ~`, 2003 <br />to Banks and Gesso. Should the MLRB approve the permit, the operator would have 365 <br />days to submit the bond from approval date.
