Cattany <br />Acting Division Director <br />Re: Ha/dorson Sand and Grave/ Mine, App/ication M-2003-037, Recommendation For <br />Approval of App/ication. <br />Dear Mr. Martin: <br />This Office has finished the review process for the above-mentioned application. Staff is <br />pleased to inform you that it has decided to recommend approval to the Mined Land <br />Reclamation Board of the application over objections based on our analysis of your <br />application and adequacy responses having met the minimum requirements of the Act and <br />Rules and Regulations. Recommendation for approval of the application is contingent upon <br />the applicant accepting the following stipulations: <br />Stipulation No. 1: A reportab/e spi// is a spi// of any toxic or hazardous substance (inc/uding <br />spi//s of Petro%um products) within the mined /and permit area reportab/e to any Division of <br />the Colorado Department of Pub/ic Health and the Environment, the National Response <br />Center, the Co%rado Emergency P/arming Commission, any local Emergency P/arming <br />Commission, local Emergency P/arming Committee, or the State Oi/ /nspector. The Mine <br />Operator shall notify the Division of Minerals and Geology (DMGI of a reportab/e spi)/ within <br />the mined /and permit area using the same timefiame required by the permit, license, notice, <br />statute, ru/e or regulation governing the reporting of the spi// to the other appropriate agency. <br />Notice of a reportab/e spi)/ shall be Fazed to: Minera/s Program Supervisor, Division of <br />Minera/s and Geology, FAX 3031 832-8106. The FAX shall include a ca//back number of a <br />responsible company official for DMG staff to use as a contact. <br />Stipulation No. 2: The operator wi// imp/ement the groundwater monitoring program as <br />mentioned in documentation by Don May and submitted by Banks and Gesso on the <br />applicant's beha/f on September 11,2003. The Division will require three (3) up gradient <br />and three (3/ down gradient wells be installed prior to any ground disturbance in any one <br />phase. The we//s shall be monitored week/y on the same day and time for depth to water <br />for one (fJfu// year. The data shall be logged and submitted to the Division as a sing/e <br />report that wi//summarize the data for analytical purposes within 60 days of the 1 year <br />anniversary of commencement of monitoring. <br />
