Doc Date:12/11I2001 'II'I'II"I"1" II~ <br />_ l ~~ Section 816.42 - Hydrologic balance: Water quality standards and <br />• effluent limitations. <br />(a)(1) All surface drainage from the disturbed area, including dis- <br />turbed areas that have been graded, seeded, or planted, shall be passed <br />through a sedimentation pond or a series of sedimentation ponds before <br />leaving the permit area. <br />(2) Sedimentation ponds and other treatment facilities shall be main- <br />tained until the disturbed area has been restored and the vegetation <br />requirements of Sections 816.111-816.117 are met and the quality of the <br />untreated drainage from the disturbed area meets the applicable State <br />and Federal water quality standards requirements for the receiving <br />stream. <br />(3) The regulatory authority may grant exemptions from these require- <br />ments only when: <br />• (A) The disturbed drainage area within the total disturbed area is <br />small; and <br />(S) The person who conducts the surface mining activites demonstrates <br />that sedimentation ponds and treatment facilities are not necessary for <br />drainage from the disturbed drainage areas to meet the effluent limi- <br />tations in the table below and the applicable State and Federal water <br />quality standards for downstream receiving waters. <br />(4) For the purposes of this Section only, disturbed area shall not <br />include those areas in which only diversion ditches, sedimentation <br />ponds, or roads are installed in accordance with this Part and the <br />upstream area is not otherwise disturbed by the person who conducts the <br />surface mining activities. <br />(5) Sedimentation ponds required by this Section shall be constructed <br />in accordance with Section 816.46, in appropriate locations before <br />. beginning any surface mining activities in the drainage area to be <br />affected. <br />816-33 <br />
