(c) In no case shall Federal and State water quality statutes, regu- <br />lations, standards, or effluent limitations be violated. <br />Section 816.41 (b) Continued. <br /> <br />Changes in water quality will be minimized during operations <br />through the use of sediment control facilities and proper mining <br />techniques. The quantity of water available for the approved poat- <br />mining land use, after the sediment control facilities are re- <br />claimed, will not be appreciably affected by the mining operations. <br />Depth to ground water will not change appreciably outside the <br />permit area. <br />J <br />I. <br />Water quality standards and effluent limitations at the existing <br />and proposed mining area are and will be regulated by the U. S. <br />Environmental Protection Agency and the Colorado Department of <br />Health under the terms of NPDES Permit No. CO-0030724 (see Exhibit <br />33, NPDES Permit) and by the Office of Surface Mining pursuant to <br />those portions of 30 CFR 816.42 currently in effect or as hereafter <br />promulgated. Compliance with applicable effluent limitations will <br />be attained by diverting undisturbed runoff away from disturbed <br />areas, prompt backfilling and revegetation, sediment detention, and <br />use of contour furrows, mulch, diversion ditches and sedimentation <br />ponds. Water quality control measures are discussed in detail in <br />Sections 780.21 and 780.25. <br />(d) Operations shall be conducted to minimize water pollution and, <br />where necessary, treatment methods shall be used to control water pol- <br />lution. <br />(1) Each person who conducts surface mining activities shall emphasize <br />mining and reclamation practices that prevent or minimize water pollu- <br />816-30 <br />
