Therefore, we request a continuance of <br />the decision date to May 28, 1998. <br />With this letter, we wish to answer the issues you brought up in your technical adequacy review. We will <br />provide our responses in the same order given in your letter. <br />The operator will commit to seeding topsoil stockpiles which remain in place longer than one <br />growing season. Westem Wheatgrass will be broadcast on the stockpiles at a rate of 30 pounds <br />per acre. Significant bare spots on the stockpiles will be re-seeded during the next growing <br />season. <br />2. The operator commits that the steepest grade on reclaimed slopes will be 3H:1 V. <br />3. The expected maximum depth of the excavation will be 8,040 feet, which will occur at the <br />southern end of Phase 3. We estimate that the depth of the groundwater is 7,960 feet elevation. <br />A natural spring occurs a short distance away at this elevation. The operator commits to notify <br />the DMG and the Office of the Stale Engineer immediately if an accidental exposure of <br />groundwater occurs at the site. In addition, the operator will backfill such groundwater exposure <br />with two feet of native fill until a consultation is held with the Office of the State Engineer. <br />4.
