(LRM), P.O. Box 229, Colorado 80539, has filed an <br />application for a Reclamation Permit with the Colorado Mined Land Reclamation Board (the <br />Board) under provisions of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials. <br />The proposed operation is known as the Bokelman-Walters Pit. The applicant's property is <br />located on approximately 201 acres in Section 24, Township 5 North, Range 68 West, of the 6"' <br />Prime Meridian, just northwest of the intersection of Hwy 402 (LCR 18/WCR 54) and County <br />Line Rd (LCR 901/WCR 13). <br />The Colorado Division of Reclamation, Mining, and Safety (the Division) requires notification to <br />owners of permanent man-made structures within 200 feet of the affected land. "Affected Land" <br />means the surface of an area within the state where a mining operation is being or will be <br />conducted, which surface is disturbed as a result of such operation. The pit area is the actual <br />limit of excavation as shown in the enclosed Mining Plan Map, Exhibit C-2. The location of LCR <br />901 (County Line Road) in relation to the proposed limit of mining is provided with this exhibit. <br />The maximum depth of mining will be 30 feet with pit walls on the east side of the property <br />excavated to a maximum steepness of 2H:1V. 2H:1V slopes are extremely stable and <br />protective of any structures above this excavation, including the road. <br />The Division Construction Materials Rule 6.4.19 (a) and (b) requires that the applicant may <br />either: <br />(a) provide a notarized agreement between the applicant and the person(s) having an interest <br />in the structure, that the applicant is to provide compensation for any damage to the <br />structure; or <br />(b) where such an agreement cannot be reached, the applicant shall provide an appropriate <br />engineering evaluation that demonstrates that such structure shall not be damaged by <br />activities occurring at the mining operation. <br />Enclosed is an agreement consistent with (a) above -offering to provide compensation to you <br />should any damage occur to your structure as a result of mining. Please review and consider <br />this agreement. If you choose to enter this agreement, please return TWO signed and notarized <br />copies in the enclosed envelope WITHIN 30 DAYS.
