Resolution #98- ~ • • <br />Page 7 <br />3. Mining operations shall be limited to the period from May l to November 14, <br />annually, as approved by the United States Forest Service. <br />4. No later than October 10th each calendaz year, the Applicant shall complete any <br />surface construction in order to minimize noise and visual impacts associated with the mining <br />activity; Applicant shall complete electric line installation for the purpose of providing power for <br />mining equipment as soon as financially feasible, to be addressed at each annual review; <br />perimeter landscaping for screening purposes as required by the Forest Service shall be <br />maintained continuously, and such fencing as required for safety by the Forest Service and other <br />state or federal regulating agencies shall be maintained continuously. 'fhe Applicant shall abide <br />by all terms of his approved Operating Plan by the United States Forest Service, as approved <br />June 9, 1992, and amended on May 6, 1993, October 6, 1994, June I, 1994, October l2, 1994, <br />May l6, 1995, as authorized under a Decision Notice issued by [he acting Sopris District Ranger <br />on May 24, 1992, and Alternative 5 of the proposed Supplemental Plan of Operation submitted <br />on Mazch 7, 1995, as authorized under Decision Notice dated August 22, 1995, by District <br />Ranger, Kevin Riordan, as modified June 24, 1996. <br />5. The Applicant is also operating pursuant to a Mined Land Reclamation Division <br />Permit issued in 1991, as it may be amended from tune to time. The Applicant shall abide by all <br />terms and conditions of this Permit at all times. At such time as Applicant engages in mining <br />activities as defined by the State of Colorado outside of his current state permitted area, <br />Applicant shall have in place the Section 110(2) Permit and required bond. <br />6. Whenever Applicant seeks an amendment to any existing federal or state permits, <br />the written documents submitted to either the United States Forest Service or the Colorado <br />Department of Minerals and Geology, shall be submitted simultaneously to the Pitkin County <br />Community Development Department. To the extent that any permit amendments change any <br />previ. ttsly approved operation, and ~Itus affect the conditions of this Permit, Applicant shall <br />sped ;~ all such changes in his statement submitted for annual review, and the Board may impose <br />additi~mal conditions at each annual review. Applicant may operate under the federal or state <br />approved changed permit conditions until each annual review. <br />7. Operations shall be consistent with the standards in § 3-250.60A, set forth in <br />Recital paragraph 9, above, except as follows: <br />a). Instead of subsection 3, Applicant may operate from thirty minutes after sunup <br />to thirty minutes before sundown. <br />b). Instead of subsection 5, Pitkin County Noise Abatement Ordinance 92-06 shall <br />apply, except that standards for the P.S-30 zone district shall apply to noise levels <br />measured at nearby residences, including Swiss Village, and industrial standards <br />shall apply to noise levels measured at the national forest boundary adjacent to the <br />nearest residence.
