Resolution N98- ~ • • <br />Page 4 <br />3. Hours of operation, unless otherwise specified, shall be <br />from 7:00 a.m. to 7:00 p.m., unless special permission is granted <br />by the Board. <br />4. Operations may be required to be fenced, or otherwise <br />enclosed for health and safety protection. <br />5. Sound levels must comply with Pitkin County Noise <br />Standards or other specific standards as may be approved by the <br />Board for a specific development. <br />6. Material, equipment, machinery, or vehicles, no[ intended <br />for immediate use or servicing of the exploration or mining site <br />shall not be stored on site. <br />7. Exploration or mining sites and all permanent installations <br />shall be maintained in a neat, clean and orderly condition. <br />8. All surfaces of permanent buildings and structures shall be <br />painted and maintained in a neat and orderly manner. <br />9. Operations may be limited [o certain seasons and time of <br />day to protect wildlife. <br />10. in addition, the County asserts jurisdiction under its police powers, as reserved to <br />the states, :, •I as a subdivision of the state, under 16 U.S.C. § 480, which provides as follows: <br />The jurisdiction, both civil and criminal, over persons within <br />national forests shall not be affected or changed by reason of [heir <br />existence, except so far as the punishment of offenses against the <br />United States therein is concerned; the intent and meaning of this <br />provision being that the State wherein any such nationaU forest is <br />situated shall not, by reason of the establishment thereof, lose its <br />jurisdiction, nor the inhabitants thereof their rights and privileges <br />as citizens, or be absolved from their duties as citizens of the State. <br />I I . Applicant has previously received Forest Service approvals for his operations, by <br />virtue of the White Banks Alabaster Mine Plan of Operations with Modifications, approved in <br />part June 9, 1992, with subsequent modifications. <br />12. In addition, Applicant has received Forest Service approval of his Supplemental <br />Plan of Operations dated Mazch 7, 1995.
