<br />Mined Land Reclamation Division - 2 - <br />August 3, 1977 <br />affect our track and right-of-way as provided in Section 34-32- <br />115 (4) (d), House Bill 1065. <br />(1) That the side wall of the pro osed excavation be <br />constructed on a slope of 12 (phorizontal) to 1 <br />(vertical), and so that no excavation nor effect <br />therefrom shall encroach upon the Railroad's right- <br />of-way. <br />(2) That good engineering practices be followed to ensure <br />that Mountain Mobile Mix's operations do not in any <br />way endanger, impair or weaken our right-of-way in <br />any manner or form. <br />(3) That no vehicles or personnel of Mountain Mobile <br />Mix's or any other company or individuals working <br />for Mountain Mobile Mix on the proposed mining <br />operation be allowed to enter upon or cross our <br />right-of-way except at established protected ~ubl~ic <br />crossings. Type of protection to be determines-by <br />the Colorado Public Utilities Commission. <br />As advised in Mountain Mobile Mix's letter, copy attached, that <br />The Rifle Telegram did not get the public notices to them "on <br />time"; by their letter, they have extended the time for filing <br />objections to 5:00 p. m. on August 5, 1977. <br />Respectfully yours, <br />C.
