--INSTRUCTIONS-- <br />WATER QUALITY CONTROL DIVISION <br />COLORADO DISCHARGE PERMIT SYSTEM <br />PROCESS WATER and/or STORMWATER <br />COAL MINING DISCHARGE APPLICATION <br />This form may be reproduced. For information on electronic copies, please contact the Permits Unit at (303) 692-3500. <br />This application is for use by all coal mining facilities with process water and/ar stormweter dischazges. It fr applicable for both general and individual permit <br />coverage. The Division has other industry-specific permits including: sand & gravel mining, constmction dewatering, gasoline clean up sites, water treatment ph <br />hazdrock mining/mOling, placer mining and minimal discharge. If the fac0ity falls under one of these activities, please contact the Division for the appropriate <br />application instead of this application. <br />WATER RIGHTS <br />The State Engineers Office (SEO) has indicated that any discharge that does not reNm water dvecdy to surface waters (i.e. land application, rapid infiltration ba: <br />etc.) has the potential for material injury to a water right. As a result, the SEO needs to determine that material htjury to a water right will not occur from such <br />activities. To make this judgement, the SEO requests that a copy of all documentation demonstrating that the requvements of Colorado water law have been me <br />submdted to their office for rtwcew. The submittal should be made as soon as possible to the following address: <br />Colorado Division of Water Resources <br />1313 Sherman Street, Room 818 <br />Denver, CO 80203 <br />Should there be any questions on the issue of water rights, the SEO can be contacted at (303) 866-3447, M-F, 10:00 am - 3:30 pm. It is important to understant <br />any CDPS permit issued by the Division does not constitute a water right. Issuance of a CDPS permit does Dot negate the Deed to also have the necessar <br />water rights in place. it is also mporant m understand that even if the activity has an existing CDPS permit, there is no guarantee that the proper water rights <br />in place. <br />GENERAL INSTRUCTIONS <br />Applicaton Due Dates: At least one hundred and eighty (180) days prar to the anticipated date of discharge for new facilities or the expiration date of an <br />existing permit, the owner (or operator if the owner does not operate the facility) of the facility shall submit an application as provided by the Water Quality Cont <br />Division (the "Division"). <br />Permit Fee: Annual permit fees set by state statute and are collected by the Division. Do not send any pavment with this application. You will be billed once yi <br />are covered under a permit. Effective July t, [ 998, there is also a fee Cor permit amendments. <br />Application Completeness: All items of the apphca[ion most be completed accurately andm thew enCveri or the application will be deemed incomplete, and <br />processing of the permit will not begin until all information is received. ff you have questions on completing this applcmion, you may contact the Division at (31 <br />692-3500. The original and two copies of the completed application shall be submitted, only to: <br />SUBMiT APPLICATION TO: Colorado Department of Public Health and Euvironmeot <br />WQCD-P-B2 <br />4300 Cherry Creek Drive Soath <br />Denver, CO 80246-1530 <br />SPECH'IC INSTRUCTIONS (Use additional pages whenever necessary} <br />Item 1 - List here the names(s) of the person, company, corporation, etc who will be responsible for the permit. <br />Item 2 - List here the owner of the property if it is different than that listed in item 1. <br />Item 3 - Self explanatory. <br />Item 4 - Provide a discussion or an organizational chart which lists the corporate strucNre of those companies which operate the facility or own the mineral <br />rights or property from which the discharges covered by this permit originate. The discussion should extend to the ultimate parent company of eac: <br />company listed. <br />Item 5 - The Standard Industrial Classification (SIC) Code for the facffity must be listed. SIC Codes are assigned according to the primary activities perform <br />by a company. They are often assigned for insurance purposes or when a business registers as a coryoration. industries can also determine their SIC <br />
