Natural Resource Trustee <br />RE: Mountain Mining Claim, Additional Adequacy Comments, File No. M-2004-008 <br />110(2) Hard RocklMetal Mining Reclamation Permit Application <br />Deaz Mr. Hazden: <br />Listed below aze additional adequacy review comments on your application for a Limited Impact <br />110(2) Hard Rock/Metal Mining Reclamation Permit Application. As previously mentioned, the <br />decision date for your application is scheduled for Apri122, 2004. Therefore, we would <br />appreciate a response from you on or before Apri120, 2004. Please be advised that your <br />application maybe deemed inadequate and maybe denied on April 22, 2004 unless the following <br />adequacy review items are addressed to the satisfaction of the Division. In the event that you <br />need additional time to prepaze an adequacy response, please state in writing on or before April <br />22, 2004 your request for an extension of the decision date. Also, please be sure to include two <br />(2) copies of your response. <br />6.3.3 EXIIIBIT C - Minine Plan <br />8. Given the location of the proposed operation, geology of the surrounding area, and mineralogy <br />ofgold-bearing deposits in this region, the Division believes there is strong potential for a) toxic <br />and/or acid-forming materials to be exposed or disturbed, and b) production of acid mine <br />drainage in sufficient quantities to adversely affect the environment as a result of the proposed <br />mining operation. (The Division considers the proposed waste rock stockpile and exposed <br />excavation to be a "Environmental Protection Facility") Therefore, the Division will consider <br />the proposed operation to be a Designated Mining Operation subject to the requirements of Rule <br />6.4.20, ie: an Environmental Protection Plan. In the event the applicant believes the proposed <br />operation will not produce toxic and/or acid forming materials or acid mine drainage in <br />suff cient quantities to adversely affect the environment and such belief can be supported via <br />results ofgeo-chemical testing, the Division encourages the applicant to meet and discuss what <br />geo-chemical tests and control methods may be acceptable for permit approval.
