Burden of Proof Requirements (continued) <br />b) For snowmelt, to waive TSS and total iron limitations, it is <br />necessary to prove that discharge occurred within 48 hours after <br />pond inflow has stopped. In addition, to waive settleable solids <br />limitations, it is necessary to prove that discharge occurred <br />within 48 hours after pond inflow volume greater than the 10-year, <br />24-hour event has stopped. <br />The Division shall determine the adequacy of proof. As part of this <br />determination, the Division shall evaluate whether the permittee could <br />have controlled the discharge in such a manner that primary <br />limitations could have been met. A11 manual dewatering shall meet TSS <br />and total iron limitations. <br />4. Post-Minine Areas <br />Commencing at the time active mining has <br />been returned to the required contour all <br />eligible for limitations other than those <br />and I.A.2. The report <br />shall address these two points: <br />The cost of modifying all existing treatment facilities to provide <br />for no salt discharge; <br />The cost of salt minimization from all treatment facilities. <br />The permittee shall specifically address a minimum of three forms of <br />treatment and/or containment for each point. The report shall <br />describe in detail each form of treatment/containment, the associated <br />construction costs, the annual operating costs and the expected <br />resulting salt loading that would result from such <br />treatment/containment. The Division will review this report. If the <br />Division determines that it is economically infeasible to construct <br />salt removal/minimization facilities, no further action shall be <br />required. If the Division determines that such construction is <br />necessary, the permit may be reopened to make appropriate <br />modifications. <br />
