Asphalt will leave in place a 20-foot berm along <br />the east portion of the property which will serve to screen <br />from view the activities from Highway 93 and any property owners <br />residing easterly from the property. Asphalt will also stock- <br />pile finished material on the easterly portion of the Pattridge <br />lease, said stockpiling to extend easterly from the 20-foot <br />berm. <br />12. Asphalt will leave the 20 foot berm in place to <br />prevent any potential surface water from draining into Upper <br />Long Lake and will not remove said berm until all of the other <br />available material has been removed. <br />13. The plan and this agreement will be updated <br />annually so that new techniques can be utilized as they are <br />produced or found. <br />14. Land Stabilization and Reclamation will be <br />maintained for a period of five (5) years after all mining <br />activities cease, and if the property is sold, leased or <br />transferred in any manner, the new owner, lessee, or person <br />having control shall agree to be bound to the unexpired period <br />of the five (5) year term. <br />15. Nothing in this agreement shall subrogate the <br />operator's responsibility for compliance with local County <br />zoning requirements. <br />16. Asphalt will furnish the Land Reclamation Board <br />a performance bond in the amount of Forty-Six Thousand ($46,000.00) <br />Dollars to insure that the work required herein will be accomplished. <br />If any of the terms, conditions and requirements of <br />this agreement are violated at any time during the period of <br />-4- <br />
