Operator will grade and stabilize the area affected <br />by this operation, contouring the ridges and piles to <br />conform with the surrounding land. <br />ST3. Land Stabilization and reclamation will be maintained <br />for a period of three (3) years after all mining <br />activities cease, and if the property is sold, leased <br />or transferred in any manner, the new owner, lessee or <br />person having control, must file a request to succeed <br />operator (LRB Form 7) with the Colorado Land Reclama- <br />tion Board or with the Commissioner of Mines, and shall <br />agree to be bound to the unexpired period of the three <br />year term. <br />Water Control, Erosion & Drainage <br />W1. If operator plans to discharge into a waterway, then a <br />permit to discharge into same will be obtained from the <br />Colorado Water Quality Control Commission. <br />W2. Operator will monitor water wells in the vicinity of <br />said operation to observe levels of said wells and <br />will arrange for a pure water supply for the users or <br />owners of wells affected by any drawdown of the water <br />table as a result of this operation. <br />W3. Operator will control erosion on or along haul roads <br />by the use of drainage ditches, culverts or check dams. <br />W4. Natural drainways or drainways constructed to alleviate <br />flood conditions in the area shall be kept free from <br />overburden, stockpiles and topsoil. <br />Ws. Operator will obtain permission from the state authorities <br />before using water from any waterway to prevent usurping <br />any adjudicated water rights. <br />-4- <br />
