Timely
completion of this fealigtrment ryou/d negate the need for a waiver from Condition #3 which
was included in the resolution because of real concerns for the safety of all West Baptist
Road users. The sharing of an 1&fooi rgghi-of-way with large gravel trucks was and rs still
rnracceptable ae it threatens the safely of all citizens traveling on that road.
Phase I of the said realignment can be completed in a matter of weeks, is paraIIel with work
preparatory to commercial operation of the gravel pit. Both earth-moving operations are
contingent on the same favorable weather conditions, the right-of-way has been surveyed
and marked, the Dellacroce heirs have agreed to provide the right-ofrway and the County
has agreed to construct the new road.
Therefore, the citi'ena of the area west and south of the Dellacroce Ranch do not nee why
this waiver of a condition alaced because of safety concerns should receive favorable
consideration if both varfies proceed forthwith with the transfer of the agreed upon righhof-
way and with the expeditious construction of the already-designed roadway.
Further, it should be noted that the September 1994 completion date was based . an. the
completion of Phases I and II under the worst possible situation, iaclading the possibility of
severe adverse weather conditions. The County has already indreated that it would proceed
with this project as rapidly as possible.
Fitully, please be advised that, on 7 January 1994, the property owners submitted a complete
file comprising their individual agreements to pay their agreed-upon share of the cost of
construction of Phase IL The citizens have done all that they can. Timely completion is now
the responsibility of II Paeo County Government working in cooperation with the
Dellacroce heirs on a schedule that will satisfy considerations for the safety of Baptist Road
users as well as the legitimate business interests of the Dellacroce family.
For your information, I will be out of the area from 13 January to 6 February 1994. In my
absence, all questions should be refemd to my neighbor, Jim Drewry, at 481-3804.
Cordially yours, ~,
~-- •. c~. ~qr.,~
~v 1
