DhOni I <br />4 -S~ -7e.3o 0 <br />wr ~~ <br />PIS: ~~:'~~ D-^r. <br />Re: Dellacroce Gravel Pit Resolution #93-286, Land use-79 <br />Dear Mark, <br />We are expecting to receive our final approval for mining from <br />the Division of Minerals and Geology on the 31st of January, 1994. <br />As you know, our approval from the County Commissioners in <br />condition number 3 states that trucks hauling gravel shall not use <br />the 18-foot right-of-way portion of Baptist Road unt11 the proposed <br />realignment/by-pass for Baptist Road is constructed. We have come <br />to an agreement with the E1 Paso County Department of Public Works <br />for a complete re-alignment of West Baptist Road. However, Don <br />Smith of the Department of Public Works feels that all of the <br />necessary planning and scheduling may delay the finish of <br />Construction until September 1, 1999. This 15 considered an outside <br />possibility by Don Smith and Max Rothchild with the hope that it <br />could actually be completed much sooner. We would therefore like to <br />ask the County Commissioners for permission to use the 18-foot <br />right-of-way on an interim basis. we would propose using the road <br />beginning with State approval of the permit until the completion of <br />the realignment or until September 1, 1994. <br />Also at this time we could accomplish the recording of a <br />corrected legal description of the pit and sedimentation pond. As <br />I understand from the surveyor there was an error in the calls as <br />recorded because of a "translation error from using maps with <br />different scales." Apparently the maps were right but some of the <br />distances and bearings were slightly off. I am enclosing the <br />corrected legal with this letter. <br />If you need anything further from me to schedule a hearing <br />before the Commissioners please call me at 634-4155.
