Acute WET Testing - Outfalls 011. 013 and Ol7 (continued) <br />(i) Toxicity has been demonstrated in the effluen[ and [he permi[ does not contain a [oxicit limitation. <br />(ii) The PTUTIE results indicue thu the toxican[ (s) represen[ pollu[ant(s) [ha[ may be controlled with specific <br />numerical limia, and the Division agrees [ha[ the numerical con[rols are [he most appropria[e course of <br />anion. <br />(iii) The PTI/TIE reveals other unique condi[ioru or characteristics which, in [he opinion of the Division, justify <br />the incorporation of unanticipated special conditions in [he permit. <br />4. chronic WET Testing - Outfalls 004. Ol? and Ol6 <br />(a) Testing and Reoortin~ Requiremen[s <br />Tests shall he done at the frequency listed in Part I.B.1. Test results shall be repotted on [he Discharge Monitoring <br />Report (DMR) submitted for the reporting period during which the sample was taken. (i.e., W'ET [esting results far <br />[he firs[ calendar quarter ending March 31 shall be reported with [he DMR due April 23.) The results shall be <br />submitted on [he Chronic Toxicity Test report form, available from the Division. Copies of these reports are to be <br />submitted [o both [he Division and EPA along widr the Dtv1R. <br />The permittee shall conduc[ each chronic WET [est in general accordance widi methods described Short Term <br />Methods for Estimatin¢ the Chronic Toxicity of Effluen[s and Receivine Waters to Freshwater Orymisms, <br />EPA/60014-89/00 L or the most Curren[ edi[ion, except as modified by the mos[ Curren[ Division widance document <br />entitled Guidelines for Conduc[ino Whole Effluent Toxicity Tests. The permittee shall conduc[ such tests using <br />• Ceriodaphriia dubia and fa[head minnows. <br />(b) Failure of Test and Division Votification <br />Beginning on the effective date of this permit, a chronic WET [es[ is failed whenever there is a s[a[is[ically significant <br />difference in le[hality between the control and any effluen[ concentra[ion less [ban or equal [o [he ins[team waste <br />concen[ra[ion ("IWC"). The IWC for ou[falls 011. OL?, 013 and 017 has been determined to be 100','0. The IWC for <br />ou[falls 004 and 016 hu been determined to be 9.9°'0. The permiaee mus[ provide written notification of the failure of <br />a WET [es[ to the Division, along with a s[a[emen[ as [o whe[her a Preliminary Toxicity Investigation ("PTI")/Toxicity <br />Identification Evaluation ('TIE") or accelerated testing is being performed. Notification must be received by the <br />Division within 21 calendar days of the demonstration of chronic WET in the routine required test. <br />"Demonstration' for the purposes of Pans LB.4(b),(c),(d), (e) and (g) means no later than the last day of the <br />labora[ory test. <br />(c) Autama[ic ComRliance Schedule Uoon Failure of Test <br />If a routine chronic WET test is failed, the following automatic compliance schedule shall apply. As part of this die <br />permittee shall either. <br />(i) proceed to conduct the PTI/TiE investigation as described in Pan I.B.4.e, or <br />(ii) conduct accelerated [esting using the single species found [o be more setui[ive. <br />If accelerated testing is being performed, the permittee shall provide written notification of [he results within l•l <br />calendar days of completion of the "Pattern of Toxicity"/"No Toxicity" demonstration.
