Acute WET Testing - Outfalls Ol 1. 013 and 0t7 (continued) <br />Any permittee tha[ is required to conduct a PTI/TIE inves[iga[ion shall do so in conformance with procedures <br />iden[ified in the following documents, or as subsequen[ly updated: 1) Methods for Aquatic Tozici[v ldentification <br />Fvaluations. Phase [ Tonicity Characterize[ion Procedures, EPA/600/6-9I/003 Feb. 9I and 2) Methods for Agymic <br />Tonicity Identification Evaluations. Phase [I To~ici[v Identification Procedures, EPA/600/3-88/035 Feb. 1989. <br />A third document in dtis series is Methods for Aquatic Tonicity Tdentification Evaluations. Phase III Tonicity <br />Confirms[ion Procedures, EPA/600/3-38/036 Feb. 1989. As indicated by the tile, this procedure is in[ended [o <br />confirm the[ the suspec[ed [ozicanr is truly the toxicant. This investiga[ion is optional. <br />Within 90 days of the de[ermina[ion of [he [ozicant or no la[er [han 210 days after demonstration of toziciry, <br />whichever is sooner, a control program is to be developed and received by the Division. The program shall set down <br />a method and procedure for elimina[ion of the tonicity to acceptable levels. <br />(e) $gguest For Relief <br />The permittee may reques[ relief from further inves[igation and tes[ing where the [ozicant has no[ been determined and <br />the Division has determined suitable treatment does not appear possible. In requesting such relief, [he permittee shall <br />submit ma[erial sutficien[ to establish the following: <br />(i) It has complied with terms and conditions of the permit compliance schedule for [he PT[/TIE investiga[ion <br />and other appropriate conditions as may have been required by the Division; <br />(ii) During the period of the [oziciry incident it has been incompliance with all other permit conditions, <br />• including, in the case of a POTW, pre[reatmen[ requiremen~s; <br />( iii) During the period of the [oziciry incident it has properly maintained and operated all facilities and systems of <br />rrea[ment and control; and <br />(iv) Despite [he circumstances described in paragraphs (i) and (iii) above, the source and/or cause of toziciry <br />could nor be located or resolved. <br />If deemed appropriate by the Division, the permi[ or the compliance schedule may be modified to revise [he ongoing <br />moni[oring and [oziciry investiga[ion requirements [o avoid an unproductive ezpendimre of [he permittee's resources, <br />provided dta[ [he underlying obliga[ion [o eliminate any continuing ezceedance of the toziciry limit shall remain. <br />(f) ~ponraneous Disappearance <br />If toziciry spontaneously disappears a[ any [ime after a test failure, dte perminee shall no[ify d[e Division in wri[ing <br />within Id days of a demonstration of disappearance of the toziciry. The Division may require the permittee to develop <br />and submit additional informs[ion which may include, but is no[ limi[ed [o, the results of additional testing. If no <br />pattern of [oziciry is iden[ified or recurring toziciry is not iden[ified, [he toziciry incident response is considered closed <br />and normal WET [esting shall resume. <br />(g) Tozici[v Reooener <br />This permit may be reopeaed and modified (following proper administra[ive procedures) to include new compliance <br />daces, additional or modified numerical permi[ limi[ations, a new or differen[ compliance schedule, a change in [he <br />whole effluent [oziciry testing protocol, or any other conditions related [o the control of [ozicants if one ar more of [he <br />following events occur: <br />Amendment Yo.
