PART I <br />Page 6 <br />Permit No. CO-0038776 <br />A. TERSIS .1ND CONDITIONS <br />2. Burden of Proof Requirements <br />The permittee has the burden of proof when seeking relief from total suspended solids (TSS), total iron and/or settleable <br />solids (SS) limitations. Discharges from ou[falls 007, OI 1, O12, 0l6 and Ol7 are not eligible for this exemption. Outfalls <br />001 and Ol6 are eligible for relief Fram TSS, total iron and SS; however, the majority of the loadine from any discharge <br />has to consist of storm runoff for the relief to be available. The permi«ee will need [o show that exceedence of [he <br />applicable limitations was caused by precipitation and nor mine water, throueh a comparison of the loading from each <br />source. The remaining permitted outfalls (005. 008, 009, O11, OIS and 013) are elie[ble for relief from TSS, T. iron and <br />SS since only surface runoff discharges are authorized from these outfalls. <br />Relief may be granted for each discharge occurrence only when necessary and shall not be granted when the permi«ee has <br />convol over the discharge. The permittee should endeavor to meet the primary limitations whenever possible. <br />a) For rainfall. to waive TSS and total iron limitations, i[ is necessary to prove that discharge occurred within 18 hours <br />after measurable precipitation has slopped. In addition, to waive settleable solids limitations, it is necessary [o prove <br />that discharge occursed within 18 hours after precipitation greater than the IO-year, 21-hour event has stopped. <br />b) For snowmelt. to waive TSS and total iron limitations, it is necessary to prove [hat discharge occurred within 13 hours <br />after pond inflow has slopped. In addition, to waive settleable solids limitations, i[ is necessary to prove that discharge <br />occurred within 13 hours after pond inflow volume greater than [he l0-year, 21-hour event has stopped. <br />Should a precipitation even[ or snowmelt occur, the permittee shall submit adequate proof in order for an exemption [o be <br />claimed. Weather station data may be appropriate in making this demonstration. Said proof shall be submitted as an <br />attachment [o the Discharge Monitoring Report (DMR) for the appropriate period. The Division shall determine [he <br />adequacy of proof. As paz[ of this determination, the Division shall evaluate whether the permittee could have controlled <br />the discharge in such a manner [ha[ primary limitations could have been met. All manual dewatering of ponds dta[ aze <br />equipped with automatic dewatering systems must meet TSS and total iron limitations. If a pond has only manual <br />dewa[ering capability, relief is available only to the extent required to regain necessary stability and capacity. <br />3. Post-Mining Areas <br />Commencing a[ [he time active mining has ceased and surface areas have been returned to [he required contour and <br />revege[ation has begun, applicable discharges may be eligible for limitations other than those specified in Pans [.A.1. <br />These post-mining limitations shall remain in effect until bond release. The permittee shall notify the Division a[ the <br />appropriate time so [ha[ consideration of permit modifications can be made. <br />4. Salinity Parameters <br />In order to obtain an indication of the quantity of Salinity being discharged from the site, the permittee shall motti[or [he <br />wastewater effluent at the following frequencies: <br />ut all re uencv Sample Tvoe <br />004, 005, 007, 008. 009, 011, 012, O13, OIS, 0I5, O16, OI7, Ol8 Quarterly Grab <br />Self-monitoring samples taken in compliance with the monitoring requires specified above shall be taken at those locations <br />listed in Pan [.B. L. <br />5. Comnliance Schedule - Salini[v Report <br />The permittee shall submit to the Division by December 1. 1995, a report addressing the economic feasibility of achieving <br />no salt in all discharges or, if [ha[ is not feasible, minimizing the salt in all discharges from this facility. The report shall <br />address these two paints: <br />• The cos[ of modifying all existing treatment facilities [o provide for no salt discharge: <br />The cost of salt minimization from all treatment Facilities (to achieve combined discharge equal to or less than one [on <br />of Total Dissolved Solids per day). <br />See Part I.C.
