operations, if the crushing and screening operations have not
occurred within the last ninety (90) days.
(5) the operation of the applicant shall not yenerate noise in
excess of 55 decibels at the boundaries of tire applicant's
property far any suhstarrtial periods of time. In order to
accomplish this, the applicant shall purchase and maintain, at
Iris sole expense, necessary monitoring equipment irr order to
show that the noise abatement measures are in compliance with
tire conditions of this resolution. The applicant shall monitor
Iris operations at all tunes in order to establish baseline data
about his operation. The monitoring data shall be available to
tare county, wirlcir the county shall have access to upon reasonable
notice to the applicant.
(6) It is the intent of the Board to protect adjoining properties
from fugitive dust from the operations of the applicant. ]n
order to accanplish this goal, the applicant will obtain a
Fugitive Particulate Emissions Permit from the Colorado State
Ilealth Department. The Air Pollution Emission Notice and
Fugitive Particulate Control Plan roust also be presented to
and approved by the Board of County Commissioners.
(1) The Board shall review coinpliarrce with this permit every six
months hereafter, notice of which bearing shall be given to
the applicant, or Iris successor's in interest, by first class
rrrail at least seven days prior to said hearing. Notice of said
hearing shall also be published in the designated newspaper of
