Joan__ A.._Nprdl ander .................................Deputy, <br />when the follo,ving proceedings, among others, were had and done, to-wit: <br />WHEREAS, application was made to the Board of County Commissioners by Nick <br />Peck for a Special Use Permit to operate a sand and gravel operation on certain real <br />property located in Ouray County, Colorado, described as the SE#SW~ Section 2 and <br />NE~NbI~ Section 11, Township 44 North, Range 8 West, N.M.P.M.; <br />WIIEREAS, the subject application Itas been found to be in proper form and <br />all notices of public hearings have been duly issued; <br />4111EREAS, a public hearing was held before the Board of County Commissioner <br />August 7, 1990, which hearing was continued until October 15, 1990; <br />WIIEREAS, the Board referred this matter to the Ouray County Planning <br />Cor[rrrrission which held a special meeting at which public comment was received on this <br />matter on August 28, 1990. The Board has received the resolution of the Planning <br />Corinnission which recomritends denial of the subject. At these hearings, a very sub- <br />stantial record has been made including both testimony and documentary evidence, <br />which has been duly considered by the Board; <br />IdHEREAS, the Board hereby finds drat the neighborhood in which the propos <br />use is to be located includes a mixture of uses including a sand and gravel operati <br />light industrial operation, agricultural uses, residential uses, and others; <br />WIIEREAS, tite record contains rrwch technical information about the impact <br />of the proposed use ort adjoining property owners and the Board recognizes that there <br />are many competing interests in this matter. The Board hereby finds that the <br />evidence in the records supports a decision either of approval with conditions or <br />denial of the application; and <br />WIIEREAS, the Bnard is desirous of approving the application with condition <br />wlriclr approval is based upon the Ouray County Land Use Code and the record made in <br />the above public hearings.
