A copy of this letter is enclosed for your <br />convenience. <br />1. Agreements between Duckels Construction, Inc. and Grant/ <br />winograsky. <br />Attached: <br />a. Denver and Rio Grande Western Railroad statement regarding <br />50~~ setback and access. <br />Attached: <br />a. Exhibit 2.A. - Copy of letter from Denver and Rio Grande <br />Western Railroad Contracts Department. <br />3. 100' buffer zone. <br />Duckels Construction, Inc. will observe a 100' buffer zone <br />between the Yampa River and the mining area. Mining activity <br />will not take place in this zone. <br />a. A haul road may be constructed along the south side of the <br />existing pond for access to the Grant/winograsky property. <br />This road may encroach upon the 100' buffer zone. However, <br />construction of this road will require only minor blading <br />to remove vegetation. The road will be covered with a thin <br />Iayer of native gravel. If this road is required, it would <br />enter the Grant/winograsky property though an existing gate <br />in the property line fence and connect to an existing road <br />on the Grant/winograsky property. <br />
