Mamie Medina <br />Jodi Bauman <br />Bazbaza Hite <br />REMARKS: <br />Realty Specialist <br />Forester <br />Physical Scientist <br />IDT Leader, CE Author <br />Realty Authorizations <br />Transportation <br />Forest Management <br />Mining <br />Cultural Resources: A cultural resource inventory revealed no significant cultural resources <br />within the area of the proposed action. <br />Migratory Birds: The Migratory Bird Treaty Act (MBTA) of 1918 was passed to regulate the <br />taking of native birds. In 2001, President Clinton signed Executive Order 13186 (66 FR 3853), <br />which directs federal agencies to further implement the MBTA by considering the effects of <br />projects and actions on migratory birds. Pursuant to this Executive Order, the US Fish and <br />Wildlife Service, BLM and Forest Service are currently working on a Memorandum of <br />Understanding. This memorandum requires agencies to review the U. S. Fish and Wildlife <br />Service Birds of Conservation Concern for species that may inhabit a project azea Bird species <br />on the list for the Southern Rockies/Colorado Plateau region which may breed within the general <br />azea of the proposed project include the Flamulated owl (Otus flammeolus). However, due to the <br />sparseness of conifer trees in the immediate project azea, it's unlikely that owls would nest there. <br />This project will result in minimal ground disturbance and is not expected to result in the take of <br />any migratory birds. <br />Threatened, Endangered, and Sensitive Species: Of the threatened, endangered and sensitive <br />species within the Gunnison Field Office, only the Canada lynx (Lynx Canadensis) wazrants <br />discussion under this proposed action. The project azea is within the 120,217 acre Lake Fork <br />Gunnison Lynx Analysis Unit. However, project area consists of sparse vegetation and is not <br />considered to be lynx habitat. Therefore, this project will have no effect on lynx or their habitat. <br />COMPLIANCE PLAN: The permit area would be inspected periodically to ensure that <br />operation and maintenance is in compliance with the conditions of the permit. <br />PERSONS /AGENCIES CONSULTED: The following individuals, groups, or agencies were <br />either provided information about the project and asked for their input or received information <br />about the project From notified parties and provided their input.
