<br />Response: The water quality data collected from the well(s) and the well log(s) are public <br />information. The information would be available from the BLM or the Colorado Division of <br />Water Resowces. <br />Comment: There were questions related to 1) the wells' depth, 2) the parameters to be <br />monitored, 3) the time frame for monitoring, 4) to whom the data will be reported, and 6) the <br />availability for public review of the data. <br />Response: <br />1) The wells' depth is tentatively projected to be no more than 100 feet, but will be <br />determined at the time of drilling and will be reported to the Colorado Division of Water <br />Resources (DWR) and the BLM after the wells aze drilled. <br />2) The parameters to be monitored aze those required by DMG. <br />3) DMG requires a minimum of 5 quarters of data. This land use permit is for a maximum of <br />three yeazs. <br />4) The water quality data will be submitted to the DMG along with their application, if the <br />applicant decides to pursue a mining operation. DWR requires that the well owner maintain <br />records of water level measurements and water quality analyses and submit those records <br />upon request. BLM will also require, as a condition of the permit, that the applicant submit <br />the well log(s) and any water quality data to BLM. <br />5) Any water quality data collected by the applicant is public information. <br />8. Comment: There were concerns that the application "does not examine the ground water <br />issues that may become a critical part of any future land use application for expansion of its <br />mining operations. The application shows only two wells at the lower end of LKA's proposed <br />shaft. The shaft has the potential for generating degraded ground water (i.e. low pH metal- <br />laden waters) that could negatively impact local water quality". <br />Response: This land use permit only gives permission for drilling and maintaining a <br />monitoring well. Any future mine development plans would be a separate proposal. <br />9. Comment: There were concerns about ensuring that the well(s) be properly drilled, cased, <br />lined, and plugged/abandoned. <br />Response: The DWR is planning on being on-site when the well(s) is/are drilled to be sure <br />well construction is done according to the State's requirements. In addition, a licensed driller <br />will construct the well(s). Licensed drillers aze awaze of, and are required to be in compliance <br />with, the State's rules and regulations regarding well construction. <br />10. Comment: There were concerns that appropriate coordination between agencies was <br />happening. <br />Response: BLM has coordinated with Colorado DMG and DWR, EPA, and Hinsdale County <br />in the processing of the land use permit application. <br />
