<br /> <br /> <br />Mr. John Hardaway <br />April 7, 1997 <br />Page 2 <br /> <br />You appealed the Office's decision to the Office Director. The Director made the <br />determination that the permit revision could be handled as a Technical Revision. As a <br />result of your appeal, the Office will process the Phase II Heap leach expansion as a <br />Technical Revision. <br />In discussing the TR with you on April 4, 1997, I indicated that the Office, due to our <br />work load, could not complete the review within the normal 30-day period required for a <br />TR. You asked that I provide you with an estimate of the amount of time necessary for <br />the Office to complete the TR review. <br />We found the application for the TR complete on March 24, 1997. Based on that date, we <br />calculate that we will need approximately 75 days to complete a comprehensive adequacy <br />review. We, therefore, request that you provide us with a letter waiving your right to a <br />decision within 30 days of the March 24, 1997 date. We recommend that you state in your <br />letter that you waive your right for a decision until June 6, 1997. <br />Sincerely, <br />~~.~_~ <br />H.
