Lunl; <br /> Uia,iun Une, mr <br />Victor, CO 80860 <br />RE: RESOLUTION OF ISSUES -Disposal of Waste Rock, <br />Amendment of Waste Rock, Acid and Metals Generation, <br />Appropriate Standards, and Documentation of Compliance <br />Dear Mr. Hardaway: <br />On Apri14, 1997, Office Staff met with you to discuss a series of items that were attached <br />to a letter dated April 4, 1997. The attachment was a draft outline intended as a guide <br />for our discussions. The draft document outlined various issues related to the potential <br />for acid and metals generation. <br />We fully expect that our concerns are administrativein nature, and that the company can <br />readily provide the appropriate documentation to verify the various permit requirements <br />concerning these issues. We also understand that there may have been various degrees <br />of disagreement as to what we have expected you to provide. One of the purposes of our <br />meeting on the April 4 was to reach an agreement about what is required to document <br />compliance with your approved permit. <br />We expect that the necessary information will be provided to the Office no later than <br />June 6, 1997. Based on a verbal commitment made by the Company at the Apri14, 1997 <br />meeting, the Company will not object to this matter being heard at the June 1997 <br />regularly scheduled Board Meeting, if necessary, even though the Company may receive <br />less than 30 days' notice of the June hearing. <br />In order to resolve the remaining issues, it may be productive for the Staff to meet with <br />the Company again. <br />On another matter, on March 24, 1997 the Office found your submittal for an expansion <br />of the Phase II Heap complete. On April 3, 1997 the Office denied the requested <br />Technical Revision (TR) on the grounds that it was an Amendment. <br />
