Lunl; Uia,iun Une, mr Victor, CO 80860 RE: RESOLUTION OF ISSUES -Disposal of Waste Rock, Amendment of Waste Rock, Acid and Metals Generation, Appropriate Standards, and Documentation of Compliance Dear Mr. Hardaway: On Apri14, 1997, Office Staff met with you to discuss a series of items that were attached to a letter dated April 4, 1997. The attachment was a draft outline intended as a guide for our discussions. The draft document outlined various issues related to the potential for acid and metals generation. We fully expect that our concerns are administrativein nature, and that the company can readily provide the appropriate documentation to verify the various permit requirements concerning these issues. We also understand that there may have been various degrees of disagreement as to what we have expected you to provide. One of the purposes of our meeting on the April 4 was to reach an agreement about what is required to document compliance with your approved permit. We expect that the necessary information will be provided to the Office no later than June 6, 1997. Based on a verbal commitment made by the Company at the Apri14, 1997 meeting, the Company will not object to this matter being heard at the June 1997 regularly scheduled Board Meeting, if necessary, even though the Company may receive less than 30 days' notice of the June hearing. In order to resolve the remaining issues, it may be productive for the Staff to meet with the Company again. On another matter, on March 24, 1997 the Office found your submittal for an expansion of the Phase II Heap complete. On April 3, 1997 the Office denied the requested Technical Revision (TR) on the grounds that it was an Amendment.
