5. Indemnification: Lessee accepts all responsibility for any and all liabilities <br />involved in the mining, crushing and removal of sand, rock and gravel from the premises. Lessee <br />agrees to indenmify Lessor against liabilities on all claims for damages and injuries to persons or <br />property that are claimed to have resulted from activities or omissions of Lessee or its agent or <br />employees during the term of this Lease. <br />6. Conditions of Premises: Lessee accepts the premises in the condition they are <br />now in and agrees at the termination of this lease or any extension thereof to leave the premises <br />in a neat condition <br />7. Warranty: The Lessor hereby warrants that the Lessor has good title to the above <br />described premises; that Lessor has the lawful right to grant this Lease and that Lessor agrees to <br />hold Lessee harniless from any and all claims from others asserting any interest in the subject <br />land. <br />8. Additional Conditions: Lessee reserves the right after termination of the Lease <br />agreement to enter said property for the purpose of reclaiming and seeding as ordered by the <br />Colorado Division ojMinerals and Geology. Said reclamation shall be completed as soon as <br />possible, but no later than one yeaz after termination of this [ease agreement. <br />9. Binding Effect: In the event that Lessor should determine to sell, mortgage or <br />lease the ]ands encompassed within this Lease, Lessor's property shall be subject to the terms of <br />this Lease. <br />10. Minimum Royalty: A minimum payment equal to $_ _Per calendaz <br />yeaz will be paid to Lessor by Lessee.
